If you are not in the US at the moment your only options are either an I129F application by your US based fiancé, or get married and have your USC spouse file the I130 for an eventual spousal visa per the link @Mike E provided. It is time for both you and your fiancé to become A-Students of the immigration process and VJ has many resources in the Guides. As an aside, the spousal visa is recommended as it is far superior, but either the fiancé visa (K1) or spousal visa (CR1/IR1) will take a lot of time, but you have an advantage as being from an ESTA country, you can come and visit during the process based on the discretion of the CBP officers. I agree with many of the others. Seems like a rushed marriage where one party had second thoughts almost immediately after the ceremony. Whether this was for an immigration benefit or not, it would seem USCIS may look at it this way.

The required evidence for submitting the N400 is fairly light (reference the link page 10). Unless you are filing from overseas or the spouse of a military member or in the military yourself, only numbers 2 and 3 apply. There is a longer list of evidence requested for the interview beginning on page 11, and many folks filing online also upload that material, but it is not required to submit an N400 application, and the applicant still needs to bring it to the interview even if they uploaded it. In my wife’s case, she filed by mail, and only included the required evidence, took the rest to the interview where the IO ignored all of it. This still has to deal with the major challenge of storing the H2. There are also issues in that an H2 fueled ICE engine does emit some bad stuff, so it might require some interesting exhaust after treatment like diesels do today.

Not necessarily. My wife chose to take my family name, but her Russian passport is still in her maiden name and it caused no issues. Once you get married and get your marriage certificate (a legal name change document recognized in the US), submit the I130 and any supporting documents in the name she wants to have on her visa/GC. She can change her passport later if she wants of it is not too much of a pain like it is in Russia. Good Luck!

It really depends on the long-term situation. Is it important for your immigrating fiancé to work immediately? Is it important for them to be free to leave the US and re-enter relatively soon after entering the US? Is money an issue? It is a tough decision for you at this point 8 months in, but you have to weigh that against the additional time it will take to do the AOS, get work authorization, get advanced parole, and the added cost of the I485. The spousal visa is far superior to the fiancé visa, but changing it at this point is a personal decision. Good Luck!
