  2. Being a business owner is not a bar to being a joint sponsor. The big challenge though is business owners have much more complex taxes which can cause NVC and possibly the consulates confusion. This is why I would only use the tax transcripts in this case. Also, yes, if your joint sponsor has their most recent tax transcripts, you only need to upload those. Good Luck!
  3. Overall, the consulate process would stay the same relative to the visa interview. As @Boiler mentioned, the DCF route is much faster as the consulate handles the entire process (no USCIS and no NVC) which is why consulates only do this based on exceptional circumstances (see link). After the divorce is sorted out, your best option is a spousal visa, but as the other responses have said, it will be scrutinized particularly if the marriage is very soon after the divorce and it appears your relationship started prior to the divorce. That being said, it is not insurmountable, but it will take a lot of work on both of your parts, and a lot of in person time together during the process. Good Luck!
  7. The processing times at USCIS for the I129F can vary widely (8-16 months) depending on which service center gets your petition. Once that is complete and approved, then the petition is sent to the National Visa Center which is part of the Department of State, and they will route it to the appropriate consulate (anywhere from 1 to 4 months). Then you are at the mercy of the consulate and their workload which can also be several months before the actual visa interview. Yes, even a K1 can take 12-24 months from petition to visa issuance and US entry. Good Luck!

  9. Depending on the advice from your lawyer and if he can get the RFE eliminated, I would respond to the RFE with the same information/evidence you provided for your I864. There are many stories of people getting RFE's for material that was already provided. Good Luck!

  16. I agree with @carmel34, if marriage is the plan, then maybe it is time to work toward that and the eventual spousal visa. Your most recent stays, and withdraw request for admittance should not impact that visa although there may be questions. You might be able to visit again during the processing of the spousal visa petition after a suitable time outside the US (6-12 months), and with work ties to Canada, but as @Ontarkie mentioned, you are flagged, so who knows if CBP will be convinced.   20. Yes, the I175 (not the I90) is required if you have a 2 year GC and it can be filed 90 days prior to the expiration date and not a day earlier. Also, if qualified, one can file the N400 under the three year rule, and similar to the I751, this can be submitted 90 days prior to the 3 year anniversary of the GC date and again not a day early.
