Alex Berenson, a vocal COVID contrarian whose past commentary on the vaccine has received scorn by critics and praise by fans, was the latest to be granted access to Elon Musk's Twitter Files, publishing his findings on his "Unreported Truths" Substack newsletter. Berenson shared an August 2021 email Gottlieb sent to Twitter's senior public policy manager Todd O’Boyle flagging a tweet written by former Trump administration official Dr. Brett Giroir, who had written "It's now clear #COVID19 natural immunity is superior to #vaccine immunity, by ALOT.   2. Including taxes when the N400 is submitted is not required evidence according to the instructions. This material is only required for the interview, but like many that file electronically, they upload this information which is not an issue. The issue is that even if uploaded, the applicant should still take paper copies to the actual interview.
  3. My wife traveled many times in her case with the GC in her married name and her Russian passport in her maiden name and had no issues. Keep a copy of your marriage certificate with you and purchase international tickets in the name on your passport, but otherwise you should be fine.

  6. This is a very good post from @Chancy. In that case the OP had an expired 10 yr GC, which does not apply here, but some of the other suggestions are very good.

  8. If you have a valid GC, you should not be kept from boarding. Review the CBP carrier guide and maybe keep a copy of page 10 with you.   9. The general school of thought right now is to get on a plane and come to the US. You may or may not be questioned by CBP about the long absence, but they cannot take your GC away. Good Luck!
  10. A one way ticket is fine for coming on a K1, and more than likely, the CBP officer will mention the 90 day requirement. However, if a return ticket is cheaper, you can do that as well. This is what we did, and moved the return date out 6 months, my then wife used it for a return trip after she got her GC.

  12. However, a marriage certificate is a legal name change document in the US and USCIS and DoS are US entities that follow US law. It is similar to same sex marriage which is unlawful in many countries, but a same sex married couple can get a US spousal visa based on US law. Regardless, I understand it is much easier to change the name in the Foreign passport first, but that can be very tough in some countries that do not accept a marriage certificate as a legal name change document.
  13. AOS is an option, but keep in mind a GC is not a glorified visitor visa. If their situation allows them to set up residency in the US and maintain that, then go for it. AP will allow them to exit and re-enter while they are waiting for their GC’s, I am not sure how long it takes for AP at the moment, last I heard was 8 or more months. As to getting pulled into secondary by CBP for this visit, do they understand the underlying reason? Was it related to potentially providing childcare for their grandchild while here on a B2?

  17. This was exactly my wife’s reasons, as a US Passport has some advantages over a Russian passport in some circles.
  18. Your profile shows K1, if you are adjusting status from a fiancé visa, there is no need for the I130.
  19. I guess I am not totally familiar with the details of the spousal visa relative to how USCIS and DoS do things differently. In theory, one should be able to fill out the I130 in the married name regardless of what is on the passport, and the consulate should honor the marriage certificate to allow that so even if the visa must be issued in the name on the passport, the GC can be issued in the married name based on the I130 like the K1/AOS process. Regardless, to the OP, it is probably best to change the passport prior to the Visa interview, and then make plans to do the name change at the naturalization stage if naturalization is the ultimate plan.   23. N400 regardless of under the 3yr or 5yr rule still implies a full review of someone’s complete immigration record. In many ways, applying under the 3yr rule should be a bit more efficient since that history is shorter, and more recent. Of course, trying to understand the inner workings of USCIS is really an effort in futility.
  24. It still all comes down to the local office and in many ways the luck of whose desk the application ends up on. My wife filed under the 3 yr rule and the Detroit FO did the work. She had her oath 5.5 months after applying.
