Yes, you do not lose your LPR status even if your CGC and extension letter are expired. Only an IJ can remove someone's LPR status. I would keep trying to get an appointment at your local office, and maybe even try a walk-in. It is such a pain that USCIS is not more customer friendly especially for its paying customers or a taxpayer, but if another US Department requires you to continue to prove your valid status, maybe you can get past the first gate at your local office and you can get an ADIT/I551 stamp. I agree with @Crazy Cat and @Jorgedig in their responses. Even though there is no set deadline for filing the I485 package after someone comes here on a K1 visa, and marries within the 90 days, most members here on VJ will recommend filing the AOS package as soon as you can gather all the documents and forms required for filing. It is good you are planning ahead at this point, and it is a good idea to budget this as a future expense that is necessary. Good Luck!

So apart from the CNN spin of attempting to minimize this criminal activity of Biden, it seems the classified documents had a Ukrainian tie. One wonders why Old Corrupt Joe would keep this information. Providing BC's of the applicant's children are not required evidence to submit the N400, but rather it is evidence needed for the interview. If she kept copies of whatever process she used to become an LPR, I would expect the BC's may be there, but otherwise, you can still submit the N400 and take the 4-12 months it will take for the interview to roll around you can get the BC's and either upload them, or wait to take them to the interview.- 22 replies

If your submission is still being processed, you should be fine. I am not aware of anyone needing to re-submit with a new version of the form unless they mistakenly used an old form after the date it would no longer be accepted (i.e. when USCIS issues new forms, they will usually set a date as to when they will no longer accept the old version). It all depends on what your and your wife’s timeframe is for fully repatriating to the US. If you are talking six months, then sure, you and your wife can come (as @Mike E stated in his correction, your USC wife has to enter the US either before you or at the same time) activate your LPR status, then come back when you are ready in six months. If you are talking more than a year, then you can apply for a Re-entry permit via the I131, but you have to do biometrics which may be several weeks after applying, so you either need to stay until that happens, or come back for that appointment. -
