  1. To the OP, don't gloss over this (bolded portion). Applying for a B2 from a VWP/ESTA country already has a fairly high bar especially when you are already showing immigration intent. Applying for a B2 and being denied will more than likely jeopardize you ability to use ESTA leaving you out in the cold as to visiting. Short trips to visit, not bringing all your worldly possessions, etc. is probably your best course. To @carmel34 +1,000!

You do realize that when applying for the N400, the required evidence is only a copy of the GC and a copy of your current marital status (marriage certificate, divorce decree, etc., not really sure what anyone submits here if they were never married, but that does not apply here) unless you are applying from overseas or as the spouse of a military member, or a current member of the military yourself. The other evidence you are showing is material requested for the interview which can be uploaded anytime or simply just copied and taken to the interview. My point is don't hold up your application to get material only needed for the interview. Good Luck!
  6. I cannot imagine getting an RFE for the wording on the LoI you described in your post. Relax a little, if for some reason someone at USCIS does issue an RFE, it is a quick solution/response. Good Luck!

  11. USCIS started de-prioritizing the I751 back in late 2016 which is when we filed our I751. Heck, back then they were only issuing 12 month extension letters, and many filers were getting cleared in less time than that, but after November/December 2016 the backlog started to grow. We didn't really care since naturalization was the final goal, we looked at the I751 as a necessary evil (read as USCIS cash cow). Back then, when my wife's N400 window opened, she filed about a month later and Detroit was very fast. When they called her for her biometrics on the N400, she was also able to talk them into giving her an ADIT stamp since her extension letter was expiring in less than 6 weeks. So much has changed, but in the end, my wife was applying for her US passport about the same time others that filed their I751 at the same time were just getting approved for their 10yr GC (my wife never actually received an actual 10yr GC since the I751 and N400 were approved at the same time). It is good to see N400's being prioritized, but USCIS needs to balance things out more, and they have at least appeared to become less user friendly.
  12. Completely agree. In my wife's case she filed by paper with a pending I751 so we only included the two pieces of required evidence for the n400. She was called to an N400 interview with no indication of the I751 other than the notice it was moved to a new office, I went with her, and the IO conducted a short (less than 5 minute) interview with the two of us and had the inch thick I751 package in front of her, (and my wife had an accordion folder with all the N400 interview requested material) we added copies of the most recent tax filings since submitting the I751, and I was escorted out and my wife proceeded with the N400 interview alone. I suspect that the massive I751 submission was part of why the IO did not ask for any N400 interview material, but who really knows for sure. My wife had her oath ceremony about 3 months later.

  14. I think your tax question has already been answered in your other thread, and I agree, this should not be an issue. As to processing times for the N400, that is entirely up to workload at your local USCIS office, but it does seem that N400 applications are somewhat prioritized. That being said, I would recommend filing as soon as possible. Please read the instructions for the N400, the actual amount of required evidence to submit the application is fairly light, don't confuse the material requested to be brought to the interview as required evidence. You do need this material for the interview, and you can upload that any time after submission or just wait and take it to the interview, but don't let it hold up your N400 submission. Good Luck!

You don't need any tax information to submit the N400 application, this is only needed for the interview and you will need to take paper copies to the interview regardless of if you uploaded it. In my wife's case, she filed in early January 2018, and when her interview came up in March, we had filed our 2017 taxes, so she brought a copy of that filing where the IO ignored it.   18. I certainly don't disagree, but I am amazed by the number of people that think they need to submit all the documents asked for the N400 that are on the list to bring to the interview. The N400 instructions show what is the required evidence to submit the application, and what is needed for the interview, but people are so worried about uploading or copying the interview material for the submission. There is no need to do that, but they do need to gather it together for the interview whether they uploaded or submitted it initially.
  19. Once you submit the AOS paperwork, you should be fine relative to being in a state of authorized stay regardless of your F1 status. My general recommendation is to get your AOS package in as soon as you can after getting your marriage certificate copies and then start to collect marital co-mingling evidence you can bring to the interview.
