  1. A little confused. The OP seems to indicate the first petition was filed for the son, and now the new I130 is for the mother (I assume there was no previous petition for the mother). If that is the case, you would indicate the son’s information in Part 5, and the city where you live(d) when you filed the I130 for your son in your mother’s I130. I don’t think the fact that the mother is in the U.S. and planning to AOS is relevant here. Good Luck!
  2. Look at the I864 instructions at the top of page 9 (for some reason, I cannot copy it on my tablet). It explains what to do if the person submitting the I864 (your spouse in this case) is not required to file taxes. He will need to include an explanation as to why and include it with the I864. Whoops, too late. Subsequently finding themselves underwater on the overall annual budget by an estimated €17 billion, they set about looking for ways to plug the hole. Farmers, Team Scholz apparently figured, can at least be bilked for cash on the pretext that the government tax subsidies for the sinful diesel fuel that powers their equipment deserve to be canceled – sacrificed on the altar of climate change.   7. What step in the process are you in? The title indicates AOS, but you mentioned sending the I129F in the OP?
  8. Hard to say since this was an F4. I130’s at NVC can be kept open indefinitely as long as they are touched once a year at NVC, but I am not sure of those that are collecting dust at USCIS.
  9. Might be a case for an immigration attorney. “Undocumented” usually means the person entered the U.S. without inspection which can further complicate any cases.
  10. To the best of my knowledge you can ignore the I751 reminder letter, and just keep getting ADIT stamps until USCIS works out the I90. Your wife deserves a 10 yr GC based on your story. If for some reason the I90 is denied, I am not sure if that is something that can be appealed. Good Luck!
  11. As @Lil bear stated, it is possible they would reuse biometrics from your wife’s and step-daughter’s AOS for the ROC and/or the REP, but it is not guaranteed. The point is they will need to remain in the U.S. after submitting the I131 until the biometrics for that application is fulfilled. Hopefully that will just be 2-4 weeks after submitting the I131, and if they are called for biometrics for both, they can take both notices to the office and hopefully USCIS will do them both at the same time.   12. Yes, this is what I thought as I have been through those internal checkpoints. The I94 from the K1 entry shows she is authorized to stay in the US for 90 days. This should suffice for any internal CBP checkpoints assuming you are inside that 90 day window.

  14. I tend to agree, it is required to file the I131 re-entry permit application from within the U.S., and also fulfill the biometrics (if required) before actually leaving. To @Vabsmith, a slight amendment to my suggestion, get the I751 in process when their window opens, and then get the I131 filled out. Then come back to the U.S. for I751 biometrics and submit the I131 immediately upon return. Hopefully, the NOA for the I131 will show up very soon after.

  16. Welcome! Immigration can indeed be daunting, and many folks use a lawyer or a service to assist. Regardless of if you do it yourself, or use a lawyer or service, the petitioner (you), and the beneficiary (your fiancé) needs to be well educated in the process as lawyers and services require you both to provide the material and evidence needed for the petition and eventual visa application. It is also a good idea for the couple to scrutinize any form or submission that will be submitted in their name. In the end, it is the couple’s choice on how to proceed. @TBoneTX already provided a good comparison between the K1 and spousal visa (CR1/IR1), so I will not repeat that. You need to decide what is most important and see which one fits you best. Good Luck!
  17. To my knowledge this will not impact the interview location unless you actually requested the change of consulates. She will have to disclose the additional residency when she fills out the DS160 or at the interview and if she is there for more than six months, I believe she will need a police report from that third country.
