  2. If you are both currently in the US and circumstances change, file away. If you have not yet filed the I130, I suggest filing it and the AOS package (I485/I131/I765/I864) altogether via paper. Good Luck!
  3. If you have a valid F1 to enter the US for school, and you enter the US for that, and on one weekend while you are here legally you decided to marry your partner you are fine. You can continue school, your USC spouse can file the I130, you can leave and come back assuming you are still in school, and when school is complete, you can leave and finish the processing of your spousal visa back home. I hope that makes sense. This is not really the case anymore. K1's have slowed does quite a bit.
  4. Sure, the F1, is very similar to a B2 in that respect. You may get extra scrutiny at each entry, so make sure you are prepared to show you do not plan to stay and adjust status with your partner. You can even get married here while on an F1 or B2 and then proceed with an I130 and consular processing. I agree with the others, and you mentioned getting your degree and working as being important, so I would pursue a spousal visa. Good Luck!
  5. You should be fine entering for school even if you have either an I129F or an I130 pending. You cannot enter with the intent to stay beyond your authorized stay (if that makes sense). I agree with @Crazy Cat, I would research the spousal visa. Good Luck!
  6. I doubt it. Since they approved the ROC with the letter in there, and since your ex provided a great deal of evidence at the AOS stage. What are they going to ask him? Personally I would not worry about it, but it is good you are thinking about all the possibilities. Good Luck!

  12. But Washington, and to some extent Oregon and California are doing even more. I believe it is Washington or Oregon that are banning "assault weapons" (I think California already has something like this on the books) which means if someone wants to move there and owns one of these bad things, they will need to check them at the door. I am wondering when CA, OR, and WA will set up state border check-points.

I don’t think the issue is just with USCIS pushing paper, there are a lot of other tentacles involved such as NARA, the FBI, state and local LE, DoS when it comes to visa applications, etc. Add to that they are responsible for handling asylum applications as well that has recently ballooned. I am not making excuses for USCIS as the job they do for the most part is pretty inefficient, but we are talking about an inefficient federal bureaucracy.
  19. Your brother falls in the F4 category, so AOS is not an option as a visa would not be available for about 16 years. You can file the I130 though to get in the queue.
