Not a lot more to add, but wanted to expand a little on what @Boiler mentioned. When your spouse's 90 day window opens to file for N400 and assuming they plan to file that online, wait at least 1-2 days (a week is probably better) to submit to avoid any weird headaches that could come from USCIS's system (see attached thread). Also, as others have said, the I751 is a separate process and will be necessary to file two years after the GC issue date less 90 days, so don't conflate that with the N400. There is a lot of debate if it is good to file the N400 while the I751 is pending. I am on the side of if naturalization is the ultimate goal, there is no reason to wait for the I751 to be finished to file the N400, but I do understand there may be some nuance related to processing times for the N400 at the local office. You list San Bernadino as the local office which is currently showing 9 months for the N400, and with the I751 taking up to four years now, I see no downside. Anyway, Good Luck!

Are you just transiting through South Korea? Anyway, my wife flew through Incheon back one time when she was on her extension letter, she had no issues as she was flying Delta and they were familiar with the process. Also, as already stated, the CBP carrier guide (page 2) shows that an expired GC and valid original extension letter (I797 NOA) is acceptable for an airline to board a person coming to the US. I think the question was related to does the ROK government care about your US status, that would be a no, they only care that you are legal to enter the ROK. The group that will care are the airline staff that will check you in to your flight back to the US. Anyway, my only other suggestion is to make a couple of copies of the extension letter and keep the original safe as you need to present the original to CBP with your expired GC. Combine this with the loss of tax revenues CA is seeing from the current exodus makes me think the residents that stay and are not eligible for this wealth transfer will see much higher taxes. Apart from that, as discussed earlier, what about the Chinese slaves CA took advantage of? What about the Native American tribes still in CA? I guess this just shows the true racist nature of the Democrats that run CA.

I love NPR's hypocrisy. If they are indeed "fact-based" journalist, then why are they upset with the label state affiliated, or state sponsored when they do get money from the government. If they really want to lose that label, then stop taking what they call a miniscule amount of funding from the federal government. Thanks for the clarification, but kind of a moot point considering the person in question has had their GC for eight years plus. The question at hand seems to be how many years an LPR has to show good moral character after a DUI conviction. As I mentioned, this is probably best answered through a consultation with an immigration attorney well versed in dealing with this sort of thing.

Since he did not get his GC via marriage to a USC I don't believe the 3 year rule applies in any way and since he has had his GC for about 8 years now it is irrelevant.
