  3. The consulate officer has the final say, and they do not always simply rely on the HHS poverty guideline. There is much unknown here, how big are the primary sponsor’s and co-sponsor’s households, where are they planning on living, etc. are factors a CO may ponder.

The consulates (CEAC) started using the term "Refused" in place of "Administrative Processing" in some instances to sort of show there is more work to be done or they are requesting additional information either from you or another department that works with the IV unit in the consulate before the visa can be issued.   11. Yes, but the application is a US form, and the US will recognize the Utah Online Marriage Certificate as soon as you have met in person after the ceremony. When my wife filed for her AOS, we used her new married name even though her passport still has her old name, and honestly, we have no plans to change her other passport name.
  12. We were pretty much the same, and I also would recommend the spousal visa route. The K1 is becoming much more obsolete given the increased processing time and the fact that the Utah Online Zoom wedding can work for same-sex couples (same sex couples in some countries that did not accept SS marriages benefitted from the K1).

  15. Seems pretty self-explanatory. What you are looking for is "Issued" which means the visa has been put in your passport. Unfortunately, you still need to wait.
  16. I don't think INA 204L applies unless the middle daughter is living/residing in the US. I am a little surprised that the F2B I130 has taken so long as the current date for India is 22SEP15, so 14 years seems outside normal processing. Here is a similar case, and unfortunately, there appears to be little recourse other than the father (assume he is the biological father) files a new I130, since as you said, the mother's I130 was not approved.   17. I agree with most of the others, if you switch at this time, you go back to the start relative to the I485 form which can take 18-24 months to process and 8-12 months to get an EAD or AP. Since you are so close to actually getting the IR5, it seems prudent to stick with that route unless there is a substantial circumstance back in the home country. Also, you need to understand the potential headache that could occur if the US Government bureaucracy does not actually communicate with each other properly.   18. Yeah, that was interesting, and in that case, they were planning on coming back to the US to stay. Regardless, I thought might have been a fluke, or maybe the system was never set up for instances where an LPR would apply.
  19. No, you are fine with your wife's application. As to the 2nd question, yes, each child separately will be listed as the principle immigrant on their own I864 in Section 2, and for Section 3 you would not list the others, but in Part 5, the household size should be the same on all three I864s.   20. Can a US LPR get an ESTA without filing the I407 first? I agree the way the OP wrote the post it does not appear that they want to live in the US permanently at this time. Why not come with the GC, and if hassled at CBP and the plan is to not stay permanently sign the I407 at the border and attempt to get a 10 yr B2?
  21. Efficiency? How many years did it take for the politicized DOJ to come up with the Hunter Biden plea deal? Also, there is nothing wrong with plea deals, the stats are correct, but most of those deals include some level of incarceration for the same crimes the Biden family and other Democrats seem to get away with.
  22. Hunter should have never been offered a deal on the gun charge, and to my knowledge I am not aware of any plea bargains being offered to Trump. Besides, I think Trump is doing this for the attention and to show the sad political state of the DOJ as evident by how they treated Hunter. I do wonder how Wesley Snipes feels.
  23. For me is was luck, or fate, or Devine intervention. Like the OP, I was mostly fine being single, but I did feel the need for something more. One day, a click on a website and the rest is history. My wife and I discuss this often, we have come to conclusion that something was happening to have us both clicking at the same time so-to-speak. I am not sure why I looked in Russia, to my knowledge it was nothing specific, but after two visits over two years and countless video chats we knew, and started the process. A little over 11 years later, it seems like it was just yesterday. Now I am not saying anyone should wait for fate, but hey, it worked for us.
  24. This is why your wife should file I130s after she arrives with you. If you take Plan B, you have to arrive with her (or before her), and you can set up domicile then you can always go back. Once she gets a few months of employment, she can add her income to yours. But if something unfortunate occurs, then she would have I130s in place just in case.
