This is quite correct, but we don't know enough about the actual circumstances to know whether it applies in this case. It depends on the actual legal status of the visa applicant. Since the foreign spouse must leave the USA to interview for a visa that there's no guarantee they will be granted, there is also no guarantee the income will continue from the same source.

It was a US Customs and Border Patrol officer that told you that. YOU will be visiting Canada. Don't expect a problem doing that. Both of you can avoid problems by using a different, more generic, but TRUTHFUL answer to "What is the purpose of your visit?" Visiting your spouse may be the primary purpose, but not your only itinerary item. When I lived near the Canadian border, many people came across from Canada almost every day, "to play golf" or even just to "buy gasoline". I crossed to shop, or for entertainment, as Vancouver was the nearest big city, half as far as Seattle.

Note that you "FILE" a tax return. Many people think their refund is a "return". It is a refund, not a return. Once you have "filed" a tax return, you have a copy of it. A complete copy is sufficient for NVC. Under certain circumstances a Consular officer may require a Tax RETURN Transcript. There are several "tax transcripts" but only the tax RETURN transcript is relevant to US immigration. Some members (lazy typers, I guess) just type "tax transcript". It's Tax Return Transcript. For the OP, a complete copy of a tax return includes all the forms and schedules, plus W2 and 1099 forms.

I would advise ignoring it. Here's the deal. VJ is not a "democracy" where you take the majority opinion. Some opinion are more valuable than others. That message would be received anybody qualifying with assets alone, no matter how many millions. If you are comfortably (30% or more) over the 3X income requirement you need, ignore the message, by doing nothing. But, do read it carefully and take the word "may" and the phrase, "Consular Officer will decide" literally.

First, you don't "look at" the instructions. You become an A-Student of them all the way through. Then you fill the form from top of page one, in order, using Adobe Acrobat or Adobe Reader. Then the form will function properly. Look at that mailing address section again carefully, and you'll see you can enter a foreign address or a US address. -
Married is married. Have as many celebrations as you want, but do not marry twice. You cannot marry in the Philippines without signing a notarized affidavit that you are free to marry. Once you are legally and lawfully married in Utah county, you would be committing fraud to legally and lawfully marry AGAIN.....ANYWHERE.

Like I said, become an A-Student of forms and instructions, plus the process itself. Read and study in the correct regional forum here so you know the pitfalls for US/Nigeria visa issues for spouses. You start by getting the US Citizen to take charge. Or, have the US Citizen get professional help. Not everyone has the aptitude, attitude, or desire to learn such a process themselves, for something they will do once. That's why MANY hire professional help. This is primarily a "DO...it yourself" group, but I know at least one of the firms on the partner pages, does 100% of their advertising on this site. It's because many do not want to do it themselves, or just don't have the aptitude or desire to do what it takes to do it themselves. No shame in that at all. -

I suppose you COULD use it for that, but it's for additional information that won't fit, like more than two jobs or residences in the past 5 years. -

This is no problem at all. He'll be in administrative processing for several months to more than a year. The medical will get added to his file, but he'll likely need a new one in a year or so, for the visa to be issued. -

Yes, the clue is that there is no certificate to obtain from the US Government. You get the notarized affidavit instead, because a government certificate marital status does not exist. The affidavit you got was just a statement from your spouse, that the Consulate notarized. -
I would delay filing your I-864 until after you start your new job and have a pay stub in hand for a full pay period. Then, take the gross pay and multiply it by the number of pay periods is a full year. X52, 26, 24, or 12 as applicable. That is your current income. Right now, your income is zero and you are unemployed. Answer present tense questions in the present tense. Presently, you are unemployed with no income.
