    I am not sure if I have answered your question previously. The following form must be resubmitted I-485, I-131, I-765, I-864W and G1145. You need to pay USCIS fees, if you are unable to pay fill out form I-912. As soon you receive your I-485 receipt, send a copy of the receipt to your local office and ask that the case not be forwarded to the Court because you refiled your case. Make sure you submit a copy of the receipt for the I-360 as well.

Pay the USCIS fees, Fill out form I-912 if you are unable to pay the fees. Get affidavits from family and friends.Those who have been divorced for more than two years are not eligible to file a Vawa.

    USCIS is not obligated to hold your I-485; however, they are holding it until now, so I do not see any reason why they would deny it. But If your wife withdraws the form I-485 then USCIS will deny your AOS, and you will simply need to refile a new one.

    There is no need to submit anything along with the form I-864W.

    It means your I-485 wasn't held by the officer. Back then, you probably filed form I-360 and asked to put the I-485 on hold. The officer isn't obligated to put on hold the I-485. Refile a new I-485, and as soon you get the I-485 receipt send a letter to USCIS (the one that denied your I485) AND ASK NOT TO FOWARD YOUR CASE to the Court, because you refile a new I-485, and then submit copies of your new 485 and I-360 receipts.

    The letter should be sent to Vermont if you did not receive a notice regarding the transfer to Nebraska.

    The VAWA petition once approved, it goes from Nebraska or Vermont to the NBC, and from the NBC to the local office. They should transfer the petition soon.

    The transfer usually takes 20/30 days, but USCIS is messy and rarely updates regarding the transfer.

    If your I-485 was not denied then you don't have to file a new form I-485. USCIS will use your pending I-485.

    Is your attorney still representing you? if not, did you change your address with USCIS when he/she stopped representing you?

    The I-131 is used for advance parole, and the The I-765 for work permit.

    I would say you have 1% chance to have your case approved, considering what USCIS mentioned about your marriage.

    You should contact your congressperson to inquire on your behalf, if you don't have an attorney representing you.

    If your VAWA was approved then you must terminate your removal proceedings so that USCIS can adjudicate your AOS.

    What you are saying does not make sense to me. You said " I then got my I-131 and I-765 combo card around August 2023..." It means your AP and EAD are valid.. " Well, it turns out the card I had was just my I-131 and my I-765/AP card"- ????. You need the AP to reenter, and you just mentioned you had the advance parole. " I contacted my lawyer about the entire situation and she said my I-765 was never approved" .According to your statement ,you received the AP and EAD in August 2023. "I told the CBP agent that my lawyer submitted the paperwork for both my renewals". IF you got the AP/EAD in August 2023 why did you submit the paperwork for renewal?.

    If you didn't receive any letter from Vermont saying they transferred your case to Nebraska then send the form I-765 to Vermont.You can enter without problem if your AP is valid.

    They are taking 6/8 months to issue the work permit.Now you just wait for your work permit and Aos interview, in some cases they waive the interview.

    File with your correct name and send a letter explaining their mistake. You have to ask them to fix your name because they messed up big time .

    Usually when the person has two first names like her, they write the first name like they wrote ok.She will be fine.
