  1. Uscis will not take into consideration what he will tell them, but they will consider his letter if he submits an annulment . Did you submit a psychological evaluation?
  2. It’s not just to write something , the professional must write EVERY abuse that you suffered and he/she needs to do the BAI and the BDI test as well .
  3. If the marriage annulment is granted you won’t have eligibility for a Vawa case .
  4. If you didn't get a letter from USCIS saying your file was transferred to Nebraska, then submit form I-765 to Vermont.
  5. Contacting the Ombudsman won't hurt your case, but did you file a motion to reconsider?
  6. You should end your attorney's representation in writing, and let USCIS know that all mails should be forwarded to you since you don't have an attorney anymore.
  7. If you leave without a valid AP your case is considered abandoned ,file a new AOS.
  8. You will not receive an answer, but they will respond to the congressman's inquiry.
  9. Even one day before the expiration of your passport, you may return to the United States Even one day before the expiration of your advance parol you may return to the United States. Please ensure that your passport is valid for at least six months prior to your trip.
  10. I am not sure if I have answered your question previously. The following form must be resubmitted I-485, I-131, I-765, I-864W and G1145. You need to pay USCIS fees, if you are unable to pay fill out form I-912. As soon you receive your I-485 receipt, send a copy of the receipt to your local office and ask that the case not be forwarded to the Court because you refiled your case. Make sure you submit a copy of the receipt for the I-360 as well.
  11. You need to send the self-petition to Nebraska. In the absence of a police report, you must attend therapy in order to obtain a psychological evaluation You need to submit your police clearance. You must write your affidavit stating about the courtship, marriage and abuse. If your don't have a pending I-485 then submit forms I-485, I-360, I-765, I-131, I-864W and G-1145. Pay the USCIS fees, Fill out form I-912 if you are unable to pay the fees. Get affidavits from family and friends. Those who have been divorced for more than two years are not eligible to file a Vawa.
  12. USCIS is not obligated to hold your I-485; however, they are holding it until now, so I do not see any reason why they would deny it. But If your wife withdraws the form I-485 then USCIS will deny your AOS, and you will simply need to refile a new one.
  13. There is no need to submit anything along with the form I-864W.
  14. It means your I-485 wasn't held by the officer. Back then, you probably filed form I-360 and asked to put the I-485 on hold. The officer isn't obligated to put on hold the I-485. Refile a new I-485, and as soon you get the I-485 receipt send a letter to USCIS (the one that denied your I485) AND ASK NOT TO FOWARD YOUR CASE to the Court, because you refile a new I-485, and then submit copies of your new 485 and I-360 receipts.
  15. The letter should be sent to Vermont if you did not receive a notice regarding the transfer to Nebraska.
  16. The VAWA petition once approved, it goes from Nebraska or Vermont to the NBC, and from the NBC to the local office. They should transfer the petition soon.
  17. She needs to file the form I-612. Just follow the instructions https://travel.state.gov/content/travel/en/us-visas/study/exchange/waiver-of-the-exchange-visitor/eligibility.html
  18. The transfer usually takes 20/30 days, but USCIS is messy and rarely updates regarding the transfer.
  19. If your I-485 was not denied then you don't have to file a new form I-485. USCIS will use your pending I-485.
  20. Is your attorney still representing you? if not, did you change your address with USCIS when he/she stopped representing you?
  21. The I-131 is used for advance parole, and the The I-765 for work permit.
  22. I would say you have 1% chance to have your case approved, considering what USCIS mentioned about your marriage.
  23. You should contact your congressperson to inquire on your behalf, if you don't have an attorney representing you.
