  1. Did you file a motion to terminate the removal ? .In order for the USCIS to adjudicate your case the removal must be terminated prior Uscis adjudication.
  2. You filed a new l485 then you have to pay the fee or file a waiver not to pay the fee.You mentioned that you filed before and they put on hold, but then you refiled then there is a fee.
  3. You should not work without a work permit.They will forgive you for breaking the law before you filed your VAWA petition, but don't push your luck .
  4. All cases are adjudicated in Vermont.After vAWA approval the petition goes to NBC and then local office.If it's showing the case is in Chicago then probably they approved your case.

A green card holder cannot be denied re-entry into the U.S, but the person can be referred to an Immigration hearing if the person has a criminal record or if the green card holder lives abroad . If you NEVER applied for asylum then you can travel to your home Country, and you will be able to reenter without any problem.
  6. If you didn't apply for asylum and if you are not in removal proceedings then you can return to the U.S without any problem.
  7. You can serve the divorce papers by publication ,but you need to have proof that you tried to locate him, such as sending a register letter to his last place or contacting his employer etc. You won’t have any problem because you didn’t divorce until now .
  8. Your green card can be revoked, but if your Country's situation changed since you filed for asylum case then you can return without any problems. USCIS can revoke your green card if your Country didn't change what you told them.
  9. Yes your case was approved.Usually they send the approval notice within 10 days. You don't have to contact the immigration regarding your I-485.
  10. I had cases of background check that took 6 months and others 1 and even 2 years. NYC local office takes 16/18 months to set up the interview.
  11. You can go without your attorney, but please avoid making any kind of jokes with them.
  12. You can ask your attorney to reschedule the interview or go to the interview and if you don't have the original documents that you mentioned here then your attorney should ask the USCIS to give you 15 days to submit the documents.
  13. Clearly, you're confused. Nobody is talking about divorce. You can file VAWA and live with your abuser. You can go to AOS's interview while still married, but you can't live together when you will attend the AOS interview.

Reto I am answering questions here for 17 years without charging anyone, and filed hundreds of cases without charging as well (I am attorney), but if you need Law information you should hire an attorney who can send you the USCIS memos and Laws.I don't have time to research the law/memos to send to VJ members.
  15. You CANNOT travel with an expired passport.You must show your VALID passport to travel abroad and to return to the U.S.
  16. Set up appointment with info pass and bring a copy of your I-797 regarding your advance parole and I-485, and the USCIS will stamp the advance parole for you to travel.
  17. If you never filed for asylum and if you are not in removal proceedings then you can travel ok.
  18. I suggest you to read about VAWA and adjustment of status based on VAWA, because clearly you have no clue about the Law.Good luck.

Your assumption is wrong, most of my Vawa cases were approved without any primary evidences(joint account, tax return, credit card, etc). He will not qualify because he never lived with his spouse after they got married.
  20. You didn't live with your spouse after you got married then you can't file Vawa. Vawa requires proof that you lived together with the abuser.
  21. Even though you can file I-360 with your spouse, you should at least be separated when you go for your AOS interview due to the fact that VAWA is for abuse victims who are fleeing abuse.
  22. You should hire an attorney to file the mandamus.It's very complicated the writ of mandamus.
  23. You don't have to submit any document regarding your form I-130.
