  1. You use the I-94 along with the K-1 visa to get the SSN when you arrive on the K-1 visa. Once you have either the EAD or GC you are a LPR in the US and are thus eligible for a SSN. A K-1 visaholder is a legal alien allowed to work so they can apply for a SSN. The SSA would love to remove this from the laws and only issue SSNs to people with the EAD or GC. A K-2 visaholder has to wait for the EAD or GC in order to get a SSN so you do not need to I-94 for anything now. Go to the SSA, complete the SS-5 form, show your EAD card and passport and you should receive your SSN--some SSA employees are a bit think when it comes to things out of the ordinary.

  2. So i already have my EAD card and i am ready to apply for my SSN. When i was researching documents to bring for applying SSN, i noticed that i have to print out an i94 again but when i tried to download it, it just says "not found". I have no idea why because im very sure that i have downloaded one from the website before. Did they delete my record not that i have my EAD card? Do i need to have i94 to apply for SSN? I came her on k2 visa. Im confused as to why i couldnt find it now

  3. You sent in your EAD application (I-765) three months ago along with your I-485 AOS application? If so, you should be getting some results soon. As indicated in the VJ Guides, EAD and AP processing generally occur within 90 days of application filing. That your mother has her green card is good, since your K-2 derivative status is dependent on her status (AOS approval). Though, your AOS application must also go through the same adjudication process.     Special Considerations When Seeking Adjustment of Status as a K-2

    The Section 101(b)(1) of the Immigration and Nationality Act defines a "child" as "an unmarried person under twenty-one years of age." Generally, a K-2 can seek adjustment of status as the minor child of a K-1. Therefore, if the K-2 adjusts status based on the K-1's adjustment, then the K-2 can only adjust status prior to his or her 21st birthday. Several recent developments may impact a K-2s ability to seek adjustment beyond the age of 21.

    If you should attain the age of 21 years while your Form I-485 is pending, you may be covered under the Child Status Protection Act of 2002 (CSPA) (see information below).

    But what about my i-94? If i send an expired i-94 along with the other required papers, will they still approve even if its expired?

  5. But it was issued by the Philippines Embassy in France, right? Because France government can't make Phillipines passports... So I don't think there's a mistake there. It's the same thing as what charmingangel explained.

    The country who issued the passport is Philippines, even if it was "delivered" in France. It doesn't matter where it was delivered, but by who. The country who issued her passport is Philippines...

    Yes it was issued in the Philippine embassy in France. But it says there "where the passport was issued" so i guess its France? im just not so sure, im considering what you just said though. Now im confused lol

  6. I would call them and see if you can have it corrected. They can confirm with the embassy the correct visa. I'm not sure what you mean by "passport issuance wrong".

    You should study the locations of CBP offices, find the one closest to you.

  7. Check and make sure you are entering the correct format, US uses mm/dd/yyyy. If you change up the info all kinds of ways and never can retrieve info, then contact a CBP deferred inspection office and check to make sure your information was entered into the system correctly. http://www.cbp.gov/xp/cgov/toolbox/contacts/deferred_inspection/

    and also they got my sister's passport issuance wrong. Will these things matter when I get SSN and have to process my AOS? Do I have to call CBP?

    This. Do it while on the phone and the I-94 field screen before you, so you can be sure you are entering every line correctly as on their record. It's likely one field is not being entered exactly as they have it.

  9. Hello everyone! I really need help. Me and my sister entered the U.S last June 26, 2013 via K2 visa and our POE was Detroit. We weren't issued i94 because they are automated now. It's been 3 WEEKS already since we got here and I still can't access or print it out from the website because it still says "Not Found". I tried putting my 2 last names already (as some lady says), and switching my names but it still won't show up sad.png((((( PLS HELP. We need it for our SSN.
