  1. Does anyone know what the fees for AOS?

    My fiance entered the US 2 weeks ago and was told to pay a $165 fees before entering (was told that the fees is used to process her Visa and Green Card). She paid the fees via the USCIS ELIS website. Below is the link that highlights more about the fees

    Please advice. I am confused about the fees part. How is the $165 different than the $1070 that the AOS is asking for.

    I am a bit confused about the filing for Adjustment of Status.

    My fiance reached the US 2 weeks ago. Before entering the US, she paid $165 via the USCIS Elis site which stated that the fees is used to procees her greencard.

    Now that she is in the States, we got married, we wanted to see what is the next step. We already applied for a social, but do we still need to file an Adjustment of Status (I-485). This is what the USCIS site states:

    You should submit all of the following evidence and documentation with your application:

    • Two passport-style photos
    • Form G-325A, Biographic Information
    • Copy of your government issued photo identification
    • Copy of your birth certificate
    • Copy of passport page with nonimmigrant visa
    • Copy of passport page with admission (entry) or parole stamp
    • Form I-94, Admission/Departure Record
    • Evidence of your marriage to the U.S. citizen within 90 days (for K-1s)
    • Form I-693, Report of Medical Examination and Vaccination Record, if applicable
    • Form I-864, Affidavit of Support
    • Copy of approved Form I-130 or Form I-797, Notice of Action, if Form I-130 is pending (if K-3 or K-4)
    • Copies of any other approved application or waiver you have had in relation with your application for K status (Approved Form I-129F, Form I-601, Application for Waiver of Excludability, etc.)
    • Applicable filing fees
    The appilcation fees for this are close to $1070. What did we pay the $165 for??

    I am very confused.


    I filed for a Fiance Visa back in Feb. My case was then approved and moved to the Delhi Embassy. My interview date is all set for Oct 1st. However, on the interview letter they are asking me to fill a packet 4. I was under the impression that i had to fill out a pasket 3. Packet 4 has several forms which are more in lined with someone filing for a Spouse visa.


    This packet also requires I-864 and DS-260 which are different than what i already filed, signed and mailed to my fiance I-134 and DS 230. In addition the I-864 in packet 4 needs a I-485 form which is change of status (green card) form. How does this make sense. The DS people on the phone are not that informed too. Everything you email them, they have a differed answer. My interview date is 2 weeks from now and this just got more confusing than ever. We did fill DS 230 DS156 and I134 for packet 3.


    Please help. This is so confusing.

  6. We had already decided that, just to be on the safe side, my fiance is going to complete all the forms, old and new. This conversation with the TravelDocs representative just occurred yesterday so I would hope they would know what they were talking about since it's their job, but I've seen a lot of confusion from a number of folks regarding this same subject. And I thought we were finally making some kind of headway and being on the ball! UGH! My fiance was never sent Packet 3 and just got notified of his interview on Sept. 6 with an interview date of Sept. 23 (only two weeks notice!). We certainly do not want any more delays, that's for sure. And not to sound dumb, but this is the first I've heard anyone mention calling the Dept. of Health, what part do they play in this process?

    HI , even I am from India . I recieved the same answer as you . We have to fill DS-260 and all the forms which were mentioned by you . As you said that to be on safe side as you are going to fill both old and new forms , even we are doing the same. My interview is after you . Can you provide me with your e-mail address please if possible so that i can ask you for interview questions and all the forms they asked you in embassy if you dont mind.

    This file lists the following location to get the medical done. But my fiance told me that she thought only place you can do this was at Leelavati hospital. Can someone please confirm?

  8. There are a lot of bad answers in this thread. In response to me when I asked the OP's exact question some years ago, an immigration attorney (and a former consul) said: "The K-1 is a hybrid visa -- a nonimmigrant visa with immigrant intent. That's why it's always processed in the Immigrant Visa Units of the consulates."

    Yes you are absolutely right, K1 is Immigrant type as you are going to marry and stay there as USA citizen.

    Hi , after my fiance filed in USA , NVC transferred case to Delhi , now Delhi embassy says that case is in initial review. I want to ask howmuch time will this embassy take to send me interview letter and packet 3G? Any idea?

    I just got a case number from NVC and they said that the file was prepared and will be shipped to consultate soon.

    I tried to sign on to the Invoice Paymet Center and its asking for the NVC case Number and an Invoice Identificaiton Number.

    Will my NWDXXXXXXXXX be the NVC case number and if yes, then what is the Invoice Identificaiton Number?

    Viewing the visa guide will help you prepare. As well as the India portal will contain some valuable embassy specific information for you.

    1. NVC is the Department of State, once it goes to NVC USCIS stops tracking it. You'll need to get your case number from NVC (start calling) which you can then track online via the NVC website (I'm not sure how yet but I believe it's by logging into the Invoice Payment Center).

    2. You can view the necessary documents at India's US Embassy website.

    3. If I recall correctly, you'll need to mail him/her the hard copy. You'll need the hard copy of any certificates (birth/death/divorce) of the USC, as well as affidavit of support with your real signature (sign on a magazine so the imprint shows in blue ink!), and a copy of your I-129F so he/she can sign the papers on his/her end to bring to the interview. However each consulate/embassy is different so you really need to look at your embassy/consulate portal and read the reviews as well as the information that's already gathered there. That will help you the most.

  11. Well to my side of the world. The grass is not greener here. We got our NOA in the mail 2 weeks ago. I have called the NVC many times and they still dont have a case number or the file. They say that call back next week. I just called them again and same answer. The number is 603-334-0700.

    As for now my goal is to search and have the required documents ready. I hear the you need the I-134 Affidavit of support. This needs to be the original so i must get it filled out, attached my bank reference letter, my last 4 paystubs and my employment letter with it. I plan to mail it to India this week.

  12. I am a bit confused about this process at this point. I have tried calling the NVC and the person on the phone said, "I dont know any process, I just answer phones".

    My K1 was approved 3 weeks ago. Then last Wednesday i get an email that its being sent to the Department of State for Visa processing. After this i am pulling blanks. I have called them 3 times and still no case number. They say to call back next week.

    Even if i get the case number, what do i do with it? I have heard some say that you email the consulate. What is their email address? What do you wrtie in the email?

    Shouldnt the consulate call you to schedule interview? When and how do i get the packet 3? SO LOST. The amount of time this is taking. Our life is on hold due to this. How much longer??

  13. They asked me for the following evidence. Were you asked for any? Did you get a RFE? Its a good sign and shows hat the case is moving.



    1. Photos from the ceremony


    2. Proof that i visited her in the last 2 years


    3. Credit card reciepts from our meeting


    4. Affidavit from family members who attended the ring ceremony


    5. Passport copy with exit and entry stamps


    6. Proof of US citizenship


    7. Intent to marry within 90 days


    8. Copy of Indian Visa on my passport.



    In your case if you have the pictures from the ceremony and affidavits (must be Notorized) from the people (not close family) who attended the ceremony, then its good. Maker sure that the people who you get the affidavits from are in the pictures.
