Guys , I received Approval from USCIS yesterday. Just now I checked USCIS website and its says Post Decision Activity saying they sent the approval on July 1.

My PD was 30 Sep 2011. Thankyou all for your support. This site was my daily check in everyday.

Good Luck to all of you. All I can say is please be patient,I did not contact Congressmen at all. Just waited.

Yaklasik 3 hafta once congressman'a email attim fakat bir sonuc alamadim bugun bi email daha attim bakalim ne olucak.. Yemin ediyorum sabir diye bisey kalmadi!! Seriously this is getting RIDICULOUS man!! There is No One left with PD sep 2011 but me idk what else to do about it.

Guys its so random. People from 2012 are getting approved and ones from Sep 2011 have no news

According here: http://www.uscis.gov/files/form/i-485instr.pdf , you can file i-485 based on an immigrant petition if "An immigrant visa number is immediately available to you based on an approved immigrant petition".

You have to wait for NOA2 before filing i-485.

I was under same impression but see the reply from one of the attorney : I trust my company's legal firm. They are very reputed. Even they said the same.

Thank you for the email. You don’t need to wait for the I-130 approval. Once it’s current, you can submit the I-485 application together with the I-130 receipt notice. Good luck. Let me know if you have further questions.

I am from India. My PD is 29 Sep 2011 and I havent got approval yet. Its still "Initial Review" but I am becoming current as per next month Visa Bulletin. So I asked some Attorney's over internet. They all said that I can apply for 485 regardless of 130 being approved or not. Then I asked my Company's legal firm. They also said the same. The email ids of 2 different attorney's whom I asked over internet are : jp@sarmientoimmigration.com and RFreedman@clarkhill.com>. You can check with them as well if you want to.

I checked with couple of attorney's. They told me that you can apply for 485 once your PD is current even if 130 is pending. So dont worry and go ahead with next step if you PD is going to be current next month or in coming months.

I called uscis to check the status and the lady said I am on a normal processing time. I asked her what if the PD becomes current at Visa Bulletin and I still nit gotten NOA 2, what will happen. She said once the PD becomes current the uscis needs to make a decision. Would that mean there is chance to deny it? That really scary.... why they have to do that? Anyways I never heard someone denied for this type of petition.

I dont think USCIS will take a decision immediately as if something is hanging on them. I am sure they have already done the ground work on all pending applications which have the PD current. They just sit on it without any means. They use to approve 130 in 5 months 2 years back.

Hello Guys, I am also in same boat. My PD is Sep 30 , 2011 . Still not received NOA2 . Waiting !! . Does Anyone know that with 130 Still pending and my PD becoming current next month , am I eligible to apply for 485 next month OR I need to wait until 130 is approved ?
