  1. Let's put this topic to rest. New instruction on check list from Phnom Penh embassy now includes the new requirement for beneficiary in Cambodia to obtain this " Letter of legal capacity of marry" for interview ".

    For the USC petitioner, there is no requirement anywhere I could find about having the "certificate of martial status" for K1.

    This certificate is for CR1 (husband/wife) case only. USC will need this to get married in Cambodia as required by Cambodian government.

    Now USA is doing the same thing to Cambodian who comes to the US to be married, hence the new requirement for " Letter of legal capacity of marry".

    This "Letter of Legal Capacity to Marry" is for Fiance(e) Visas. I called the U.S. Embassy in Cambodia and they told me that it is a new requirement for Fiance(e) Visa beneficiaries to bring it to the interview as part of the package. However, earlier posts asked about the paperwork that is done in order to get engaged in Cambodia, for example, the "Certificate of Celibacy". I emailed a copy of this certificate and asked if this meets the requirement for the "Letter of Legal Capacity to Marry" and they responded with a "yes". I hope this clears some of the confusion up. Also, if you go to the Embassy's website and check the Packet 3 instructions they have updated the form. Good luck to all.

  2. FYI guys, I just received a letter in the mail from the NVC stating they received an approved I-129F. It goes on to say that within a week of them receiving it they will forward it to the appropriate Embassy. The letter was dated August 2. That means it took 15 days from my NOA2 to get this letter. The Embassy does already have my petition and my fiancee has mailed out the Packet 3. I'm hoping to have an interview date by the end of the week, best case scenario. I wanted to pass this on so you all can have some sort of time reference once you get approved. I'm sure some will be quicker and some may take a few days longer but that's what we do here...wait.   3. Hey how's the process going for you? Any luck with getting your file sent to NVC yet since your approval. I called them and the said it could take up to 8 weeks.

    Yes. I called them on Tuesday and they said it was sent to the Embassy already and they gave me the case number. It took 2 weeks to go from my NOA2 approval date to the Embassy. Amazing! I emailed the Embassy and they said they have the petition and will mail the Packet 3. I'm already done with the forms that I have to send the Embassy. I'm only worried about how long it will take to get the interview scheduled. I heard it can take some time.

    Just to give everyone an update and to get your opinion on if this will be enough evidence.

    I am getting ready to respond to the RFE that was sent to us on August 2nd (we received it in the mail on August 5th). Surprisingly enough my fiance's new Letter of Intent to Marry only took 1.5 days to arrive in the U.S. from Italy. It appears the postal gods are smiling on us! smile.png

    Anyways, tell me if you think the following is enough evidence to meet the "Meeting Requirements within the past 2 years".

    • New, correct Letters of Intent to Marry, both dated and signed
    • Credit Card Statements showing I was in my fiance's hometown in Italy within the past two years; also show airplane purchases made for the two of us (her name is shown on the ticket purchase on the CC statement which is a nice addition)
    • E-mail between the two of us in Feb 2013 referencing dinner plans with friends
    • Her flight itineraries of her 3 flights to see me in the past 2 years, as well as the itineraries for my 3 flights to see her.
    • Personal statement from me
    • Sworn affidavits from two people stating that we have been together, should be allowed to marry, ect.
    • Reservation receipt for beach house rental in Sept 2011
    • Email conversation regarding a Lake Cabin rental in Sept 2011 (no real receipt since it was just a man renting a property in the country)
    • Credit card statement and receipt of a dual membership to the MoMA
    • And 17 photos, all with the dates, place and our names handwritten on the back..

    Highlighted all the important parts(dates, places, ect.) They asked for more evidence so I'm giving it to them. So who wants to back me up and say we should be fine when submitting our response! whistling.gif

    And congrats to other May filers who have been approved in the past week!

    That is all good. I would also make photocopies of your passport showing you entered Italy. Other then that, that should be plenty. Good luck.

  5. Thanks everyone !! Can anyone help me out? I'm wondering what forms i need to send to the embassy in Phnom Penh after NVC send my case there. Thanks in advance. I'm going to send them an email but I've heard it can take a bit before they respond.

    Hey. Congrats on the recent success. I am in the same situation. I emailed the Embassy in Phnom Penh and got this response the same day.

    "We are pleased to inform you that your physical case file is received by the U.S. Embassy in Phnom Penh today. As such, a letter containing packet 3 information will be mailed to your nominated mailing address soon. Due to unreliable mailing system in Cambodia, we do not send the letter to the applicant. Should you wish to expedite the processing, we suggest you to download forms and instruction of the packet 3 from the following website and mail the required documents back to the Embassy to schedule appointment for visa interview."

    However, it should be noted that a hand-delivered packet 3 is not acceptable and as such, you will need to mail the documents to the Embassy through post office or courier service.

    I've been away for work but I wanted to pass on some info. So my NOA2 was July 18th. I just got off the phone with someone from the NVC and was told that the Embassy received the petition on Aug 1st. That means they got it exactly 2 weeks from my NOA2 date. I wanted to let everyone know so you can all start calling them to check the status. I think there is definitely some good vibes going around for us May people. Good luck and keep on keeping on.

    I see why this letters probably takeing long it probably has not been written yet lol. Went on USCIS website just now and saw to my horror that Vermont has a processing date up as October 15. Meaning that's the people they are currently processing god we sure do have a good 7 months if not longer to wait. Now I know not to bothe blame the mail man cos he ain't got nothing to do with that letter not arriving. Honestly it hardly seems fair that California is doing things within their time frame. God help us all.

    I wouldn't worry too much about how long it will take to get that Notice. As long as your status says initial review on the USCIS website I think you're good. These processing times seem to fluctuate quite a bit so I take those times with a grain of salt and just hope for a quick and easy processing. Good luck to us all.

    Is it not funny the differences in time from the time you got your email considering we sent ours off on the 02 of may 2013 too and received our email on the 8th may with noa1 and Vermont is also our centre. It would be good to see if we get processed the same time of if there wil be a diffrence of days again. Right now on the Uscis website our status is in the initial review. We are still waiting for the hardy copy by snail mail to come. Will keep you informed when we get it. I live in London so am hopping once Vermont finish takeing there time reviewing that the embassy in London move quicker.

    Well I live in Japan right now so even though I sent it out on 2 May, they didn't actually receive it until 6 May. Since we're so close it will be a good measure on the differences of processing time. Is London's Embassy usually quick? My fiancee lives in Cambodia and I think due to the number of applicants it takes some time to review. But I'll worry about that when the time comes. First things first. Getting through VSC.
