    You can file new I-485 but consult with a lawyer first as spouse has a ban on file. That is different than an overstay.

    As others have stated that you were required to remain single until your immigration. Your mother should have notified them when you got married and then you would not be going through this big ordeal of updating your petition.

    I agree but no one has said who is the US Citizen. How do you qualify to apply? Income/domicile/taxes. Asking how to make a smooth transition when it is rocky at the gate.

    Who is the US citizen? Husband will have to divorce one of the two wives and then you can apply. You cannot have more than one wife in the US regardless of Cultural practices

    There are more issues for your friend that she has to address. Taxes - real deductions or tax fraud resulting in income below 125%. Because of this your mother may be deemed a public charge even with a joint sponsor. insurance - you have to provide medical coverage for your mother. Insurance is not cheap. work- your mother is still working age. Unless she has a disability she can find employment.

    Does Grandfather still have his Natralization Certificate? If she was 14 when he naturalized she be a US Citizen. You will have to check the law during that time. Have you talked to an immigration lawyer about all of this.

    How many people are counting in your total. what does Line 22 on your Income Tax total is? That amount has to be over 125%. proof of income is 6 months of paycheck stubs and/or current W-2

    I-485 will get transferred to Clearing house. When Dallas states they are ready for your case to be transferred, the Clearing house will review your application, request for more information, and send it to Dallas. Dallas will determine when you will interview. No one can tell you how long that we be, however you will probably have another one year wait.

    That long of a period without pay will affect his AOS. Did you check with your Human Resources. Maternity leave has benefits with some companies including short term disability payments.

    Extension letter is only good for some years past expired GC. For example if GC expired on 3-15-2020 and your extension letter is for 2 years. Then the extension letter is no longer valid after 3-15-2022. you mentioned approved years later. What is her expired date and years on her extension letter.
