  1. No. Entering the the US with VWP or B1/B2 with the INTENT to STAY and adjust status, is visa fraud and will result in a permanent ban from the US. You must do consular processing.
  2. The airline can say no based on the laws of India. Just because they are U.S citizens doesn't save them from laws of other countries.
  3. You're worrying too much. I've been on this site for 13 years and I've never once seen a packet not getting to the intended place. The only times I've seen where they weren't delivered was if the address was wrong or their was no postage/not enough postage.
  4. If she doesn't live in Germany, she should not apply for a visitor visa using her citizenship there. She has to show strong to Germany and if she doesn't live there, she has no ties.

If she is in the U.S right now she can pursue adjustment of status. If she's not in the U.S currently or if she's in the U.S right now, then leaves only to return using her tourist visa to adjust status, she CANNOT-visa fraud.. This post alone shows intent.

  9. If he's entering with a K-1, his previous visits on ESTA have nothing to do with this visa. You're worrying about nothing.
  10. He has a 10 year GC, there's nothing you can do to have it taken away or send him home. The only way the I864 will be enforced is if he becomes a public charge, which I don't see happening with a young man his age. You can't report him for fraud, you sent in a lot of evidence to prove the contrary. You CAN report his employer for paying him under the table, neither of them are paying taxes on his income and that's illegal. If I were you I would get as far away from him as humanly possible, make sure you and your baby are safe, file for divorce and never look back. You can do this, you're a strong, intelligent woman, you have a lot going for you. I wish you the best. Have a safe delivery and congratulations on your little bundle of joy. Please keep us updated.
  11. All of this. Make sure he does it himself, do not rely on a "preparer" to do it and risk even more mistakes down the line. There are guides at the top of the page and he can come here to ask questions, if need be. It was a costly mistake to use someone else, when you do it on your own, everything is under your control, a lot less likely to make mistakes. The forms really aren't difficult, attention to detail is what's most important.

  14. Why are you focusing on everything and everything other than the relationship itself? It's not the money, his business or a million other possible things. IF he wanted to marry you, he would have moved heaven and earth to be there. Period. His excuses are a clear sign that he does not want to marry you. He even told you he had cold feet. What is there not to understand? BTW, lying to the consulate to say he missed his flight, is misrepresentation. Based on that alone, you can be denied. WHY would you ever lie to a CO????
  15. I can, a man who doesn't want to marry you. Why would you care about the time and effort you've put in thus far? Wouldn't you rather find out BEFORE he gets to the U.S. that he's going to skip out, after you've put in MUCH more time, effort and money?
  16. Why is it unethical? Immigration is a privilege, not a right. The CO doesn't think you have a bonafide relationship, I would be suspect as well. Getting engaged two days after you met for the first time in real life, is not normal. As @SalishSea stated, you need to spend a significant of time IRL with your partner before you apply for anything, especially after you were denied once already.
  17. It literally isn't luck. She has to prove that she has very strong ties to home, if not she won't get a visa. Period. Luck has nothing to do with any of it.
  18. Nope, luck is not involved in any way, shape or form. Having VERY strong ties to home is the only way she'll be successful.
  19. *Hassle. Each state has different requirements for Medicaid. If the mother has no income, savings, investments, or assets she MAY qualify. Just because you mother did, in a totally different state, with a far different financial situation, does not mean his mother will.

  21. She has no legal path to stay here, she has no choice but to go home. Why would she have "financially crippling bills later" and "get crushed" after a 2 month marriage? Am I missing something? I'm confused by these statements. She's entitled to nothing.
  22. I'm pretty sure no one wants to separate you, they're merely suggesting it as an option. And honestly, if my child had such severe ADHD, I'd make the move for him. It's only temporary and in the best interest of the child. I will add, my 26 year old son is autistic, I do know what it's like to have a child with learning challenges, I've been living it for a long time. You can bet that I would have temporarily separated from my spouse if it meant he would get the help and education he desperately needed. In fact, before my now husband and I married, I told him I would never consider moving to his home country based on the fact that my son is autistic (he also has a central auditory processing disorder) because they don't have special needs programs in the school system there.
