  1. Tricky? No they aren't. They are what they are. Airfare to and from China isn't even 10k if you travel first class. Why oh whyyyyyyyyyyyy do people come here asking for advice and then not listen??? Simple answer: if you don't want to listen to what anyone has to say, do what you want and get back to us and let us know how it goes.
  2. If he doesn't want to listen, that's not your problem. Let him find out on his own.
  3. You don't need to do any research, that's exactly what a good attorney is for. Any aggressive, talented, savvy attorney will know EXACTLY what to do, that's what you pay them for. Just because your husband is threatening you does NOT means what he says is true. As others have said, don't tell him your plans to divorce, just get out and never look back. Please.
  4. Big difference between a K-1 and a B2. Were you already planning a K-1? Are you planning to come with a B-2 and adjust status (which is visa fraud)? You left out all the details.
  5. This is the exact reason why people have trouble obtaining B2 visas, because of people like this who think that they are above the law and cheat the system.. Honestly, I hope they get caught and I hope that one day adjustment of status from a B2 is abolished.

  7. Honesty is your only option, ever, with U.S immigration. Misrepresentation can and sometimes does come with a lifetime ban.
  8. Apply for a visa and they will give you an exact answer on how long you're banned.
  9. It took my husband 7 months to find a job and it was loading trucks at Walmart. He is a computer engineer and no one wanted to hire him because he had no U.S job experience. It took him over a year to find a job in his field and at that, he had to take a job as an unpaid intern just to get his foot in the door, even though he had years of engineering experience in his home country. And yes, he had it listed on his resume that he was authorized to work here. Eleven years later and he's VP of his division (software) at a robotics company.
  10. The spouse visa (CR1) is the superior visa and it will cost you far less in the long run than a K-1.

  12. This. This. THIS!!!! There is absolutely no reason whatsoever to hire an attorney. Follow the guides here and ask questions as needed. Period. My husband and I did the entire process on our own from the original petition-up to and including naturalization-on our own and we had many so called "red flags". We never even had any requests for evidence (rfe)the entire time. I found this site after our petition was approved, just before my husband's interview at the consulate. If I had questions, I came here and I was never once given the wrong advice. You said money is tight and attorneys cost A LOT, plus time and time again we see them give VERY bad advice, and the attorney you spoke to is a perfect example of that. Best of luck.
  13. Everyone goes through AP, regardless of gender. It can be longer depending on the country.
  14. Find a new insurance company that doesn't have that requirement. There are hundreds of insurance companies in this country, best thing to do is go online and use Google, call around and start comparing prices and coverage. Google is your friend. I literally just changed my car insurance and homeowners insurance last Thursday, if you can bundle insurance (sign up for more than one policy ie:car and homeowners or renters) you will save lots of money. I found all the info I needed on Google. I switched from Liberty Mutual to Progressive and saved a few thousands dollars combined between my two policies for the same, exact coverage. It took me a few days and hours and hours on the phone to find the right fit.
  15. Time and time again we see so called "immigration" attorneys give bad advice on this site, you are no exception. By FAR the CR1 visa is the superior visa and it costs so much less than a K-1. Save yourself some aggravation and time and get married and file a CR1. You came here asking for advice and literally every member here, including senior members, have told you what to do. I've never seen anyone asking for advice on this site given bad advice, and I've been here 12 years. Just sayin'
  16. Unless you brother has a highly specialized degree and position to be hired for, the chances of his getting a work visa is about zero. A computer engineer is not a specialized degree and US employers cannot hire or sponsor foreign workers if there are equally qualified US citizens and green card holders. They are required by law to hire US workers. Both my husband and my son are computer engineers (my son works in software and holds a dual degree in computer engineering and also electrical engineering) and I can tell you for a fact that there are an abundance of computer engineers and computer science people here in the US. Others mentioned that with layoffs that it may be difficult to find a job in IT right now, but where we live (Boston) that is not the case, there are plenty of jobs in this area. But that doesn't help your brother as he does not have any special degree or job experience that would qualify for a work visa.
  17. What don't you understand about intent? It is YOUR intent for her to come and adjust status. That IS immigration fraud. Period. End of story.
  18. TBH I think that USCIS should require that the petitioner of an elderly parent should have proof that they can and will provide health insurance for said parent/s before the visa is approved. Everyone who was born in the US or has lived here for any amount of time, knows for a fact how much healthcare is in this country. As much as I am empathetic towards your dad, it should not fall on the US taxpayers to provide free healthcare/assistance or any other type of benefit because your lack of thought and planning for his needs once he arrived. It is so unfair to him.
  19. Why come here to ask for advice and go on to argue with what everyone just because you don't like what they have to say)even though it's the truth)? No one here has any control over the immigration in this country, let alone their rules. Like it or not, if she returns right away, CPB will assume that she's living here. Period. Full stop. Your retirement in 18 months and what your plans are after that have absolutely nothing to do with any of this. She was given a b2 based on her merits and her merits alone. Plus, having a US boyfriend/fiancé works against her. If you want to ignore everyone's advice and roll the dice, that's up to you, but don't be surprised if she's denied entry and her visa is revoked. Just sayin'
