Bob and I would like to thank EVERYONE on this site. Without your help, we'd probably still be in a mess of paperwork!....Bob received his 10 yr green card in the mail yesterday, without and interview!

FYI, I sent my petition on July 27 and the NSC received it on July 30th. The check has NOT been cashed yet.

If it were me, I'd re-do it..But of course I'm the paranoid one abt. everything...lol...Can you just "white out" the date, then copy the form again....then fill in the new date?...That way you won't have to re-do the whole page.

Interesting stuff, trying to figure out which date is in the 90 day window. Here's another thought: Does that mean that the date where you sign on the I-751 should also be within that window? Or does it matter if it was signed a few days earlier?

Interesting...That quote would lead me to believe that postmarked is a form of filing. (Let's see how many times I can try and disect statements from the USCIS and try to interpret them.) I will have to think about it. Nonetheless, the latest I will mail in my petition will be 7/27.

BTW, where are you at in Indiana? I am also in Indiana (Indianapolis). Maybe we were both in the waiting room at the same time on 10/25/2005...small world.

Ok...this is getting better and better...lol.......... If it is postmarked........it's filed, right? They don't have it yet, but it's filed? (I hope). Not sure I'd mail it tonight tho. Gosh, this is terrible. Even the tax people on tax day accept "postmarked"on tax day. I'm now leaning towards over-nighting it on the 27th. You are not dating your form before the 27th are you?

If your window for filling opens on the 27th then mail it in the 27th, 28th or 29th.... to pay the old fee... after that you have to pay the new fee...

If your window to file does not open until July 30th or later then you have to pay the new fee and there is no way to avoid this....

We are saying that our window opens on July 27th. Second-guessing ourselves now...lol...Guess I'll wait and mail on the 28th just to be safe and not possibly a day too early. Too bad that has to be on a Saturday. Not sure how things work being over-nighted on a weekend.

Mahal, our window opens on the same day, (whatever day that may be ) what day are you going to mail it in? When I count back from Oct. 25th...Oct. 24 being #1...day 90 is on July 27th.

IMO, You are not eligible to apply untill 07/28 as you need to count 90 days (NOT 3 months) backwards from 10/25. 90 days window means you can apply anytime between 07/28 to 10/25.

I might just be splitting hairs but a day could make a difference for some people. When I calculate October 25 minus 90 days I get July 27th. The specific verbiage on the green card says "Card Expires 10/25/07." Does this mean that the card is valid through 10/25 or through 10/24 (expiring at midnight on 10/25)? If it is the latter then the valid filing dates would be any time between 7/27 and 10/24. Any thoughts?

Card should be valid till 10/25 11:59:59 PM.

IMO, 90 day window is from 7/28 to 10/25...include both days.

I looked at the specific language from the I-751 petition and found the instructions quoted below:

"If you are filing this petition jointly with your spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires."

Since the second anniversary date is 10/25 then, IMO, the 90 days start on 7/27. It would be nice to know what the USCIS' opinion is. In any event, it doesn't really matter since both dates are before the July 30th increase.

Yes, I think it does matter because July 27th may or may not be just ONE day too early in the 90 day window. It will make a difference to those who have a card expiring on oct. 25, 2007....If we wait til the 28th...to be 100% certain, I'm not sure it will actually be postmarked that day. Someone told me, mail going out (in this town at least) leaves the post office at 6:00am........before the post office opens for customers...

Paper clip the check to the I-751 form.

Cover letter on top, then the I-751, and then the rest of the evidence in no particular order, you can order it the same as the list of contents that you may have on your cover letter.

Sending the I-751 this Saturday. I've been looking, but can't find out if there is a specific "order" to arrange all of our paperwork. I remember some of the other forms in the past had specific order.

I'm thinking the check or the exact amount on top...then the completed I-751....then any attachments for any questions on the form.....copy of green card next?.....and then all the other documentation .......anyone know if things have to be in a specific order?

My husband's card expires 10/25/07 also...Is there any reason in particular that you are not filing before the 28th. I was wondering the same thing as you and trying to make sure we don't file too soon. I'm not sure where day 1 starts (in the 90 day window). Where do we start counting from? Is July 25th day one or is July 26th day one?

Send it on the first day it is eligible to snreu tey don't send it back as "filed too soon" - as long as your envelope is postmarked before July 30 deadline for new fees you will be fine.

Bob's expiration date on his conditional card is Oct. 25th, 2007...My question is, can we send in the I-751 form ON July 25th (overnight of course)?...Or is that a day too soon? Should we wait til the 26th to be sure? July 26 is on a Thursday, July 30th, the deadline is the following Monday....I'm certain if they get it on the 30th, the price increase will already be in effect, (so I'm thinking they need to get it by Fri. the 27th) ...Just trying to beat the increase, but don't want to send it a day too soon. Which day would you send it in?

The new fees will be active starting July 30, 2007.

What you read in the paper with the fees jumping from $395 to $1010 are the fees for AOS, not removal of conditions.

With an expiry date of Oct. 25, 07, you will have to calculate excactly 90 days before that date and that is when your window opens. I estimate you can barely make it, as it should be end of July when your window opens. Get prepared to pay overnight shipping fees though.

Thank you for the quick answer....I just looked at hubby's conditional green card. It expires on Oct. 25, so that will give us just a few days to get everything there. Definately will overnight it!..........One more question......The old fee is $275.00 (including biometrics, right)?
