  1. Hello,

    I'm filing form I-751 on page 3 part 5 information about your children. We share one child together and there is also one step child. That section is also for step children? Or we are just including our child we share together?

    Both children are living with us

    Also we didn't file a joint tax return is that an issue? Should I still send the tax return as part of the package even though it's not joint?

  2. I filed an Adjustment of Status I-485 in Jan 2013, and received a letter in Feb 2013 requesting paystubs for affidavit of support. I sent everything they received it in Mar 2013. Its now February 2014 and I haven't heard anything from USCIS. I'm confused I thought this process takes approximately six months its over a year now and the work authorization is expiring Mar 2014.

    I also booked a ticket to Puerto Rico for 3 days since its a state and I've travelled to Florida before with no problems on my state ID. The travel agent is telling me that I might have an issue coming back. I don't know what to do I need advise. oh and my state ID has Visitor Temp and it expired Nov 2013.

    Does anyone have any advise on what to do?

    Does anyone know the appropriate # to call to get an answer regarding this issue?

    I'm just a little worried

    Pls advise

  4. Yes, things are different from consulate to consulate. That is true. I just looked at the pdf and your repost, and I see nowhere it says the income is based on last year's past income. Everyone must submit at least their most recent year's tax transcript. I never stated not to do this. I merely stated that the 125% requirement is based on what you CURRENTLY earned, and not what you earned last year. You can do a search here on VJ and find that what I am telling you is true.

    From your post: "Evidence of Support: You must submit evidence that you (and any accompanying children) are not likely to become a public charge (i.e. financial burden to the U.S. Government) while in the United States. Typically, evidence submitted by an applicant presented to meet this requirement of the law will consist of a Form I-134 “Affidavit of Support” completed by the petitioning fiancé/fiancée or other U.S. citizen or legal permanent resident, along with the sponsor’s most current year’s 1040 and W2, current bank statements, earnings statements, and an employment letter."

    If you read what I told the OP, I told them to get a letter from their employer and provide a few months worth of their most recent pay stubs to prove current income. They did not earn enough last year, and their taxes will show that. However, they earn enough NOW, and the letter from employer and pay stubs will prove that. It would be silly for a CO to ignore the fact they are making $37k a year now because they did not earn that much in 2011. Current income is what goes on the annual income line for #7 of the I-134, and not what it states as your income from your last year's taxes.

    To the OP> If it makes you feel better, you can write a statement as to why you did not make that much in 2011, talk about getting your new job, and that you are now in the position to support your fiance(e) above 125% of the poverty level so they will not become a public charge. You can also get a co-sponsor lined up just in case, but making what you do, I really do not think it is needed.

    I need to do a I-134 but im not sure if i need a co-sponsor.

    My 2012 estimated income is 37,000. My 2011 income was 7,800 and my 2010 was about 12,000

    based on my income for 2012 do you think the Consulate officer will asks for a co-sponor?

    are they going to take my previous income into consideration? and will it have an effect on the decision of a co-sponor?

    DS 230 has part 1 and part 2. Does my fiance have to mail both parts to the consulate or just part 1?

    Also the latest form from NVC site has an expiration date of 03/31/2012. How long do they normally take to update the site with the new form? or can i use the expired form?

    Pls advise

  7. The Jamaican finace(e) has to order the non-impediment at the Registrar Generals Department. The price is listed on the website as $5000 but I don't know for sure that this is correct. I would suggest you order the non-impediment well in advance---as in immediately once you receive your approval notice of the I-129f petition.

  8. Can Package 3 be requested via email by the petioner as oppose to mailing it to the beneficiary?

    I know that people have requested DS 230 via email but not the entire package. But i want to know if you can receive the entire package via email

    Has anyone ever done that and what was the outcome?

  9. I'm currently going thru the K1 Fiance visa process. My question is regarding The I-134 Affidavit of support

    Im currently a student going to school full time working part-time temporarily. Based on my income i will need a Co-sponor and i do have one but me working a temp job which will end in another month or two, will this affect on my I-134? or what is im unemployed at the time my I-134 is needed?

    Pls advise
