If he is receiving benefit from the VA for his classes, it does too, count as income. normally it's around $400 extra dollars a month, so make sure to count that in.

WOW! That is A LOT of evidence. We went into my interview with nothing.. literally just the copies of what we have sent in.

Tomorrow is the day..i'm finishing up the file to bring into the AOS interview tomorrow. Please critique the evidence list and let me know if i'm missing any critical items that might be needed for a satisfactory outcome.
-Birth Certificates
-DMV issued Driver License
-Passports
-EAD/AP combo card
-Certified marriage certificate
Evidence of bonafide marriage:
-Lease agreement with both names on it
-Joint Checking/savings account statements
-Joint Credit cards(2)
-Vehicle title with joint ownership
-Auto Insurance card with both names on it
-Vehicle registration with both names on it
-Family gym membership contract agreement with both names on it.
-2 photo albums..one from when we were dating and one created after marriage w/ wedding photos
-box full of polaroid photo collection from the past 4 years of our lives

Has any gone to update their status with Social Security using only their U.S. passport?
I went in with my naturalization certificate 5 days after becoming a citizen. 0 problems.

My husband has left back home. He isn't in the most stable mental condition and isn't thinking rationally. I want to be certain that while he clears his mind and figures out what he wants to do with his life (he left with no possessions nor money) that he doesn't permanently loose his right to re-enter and be with his kids. He is young and dumb and I think the hard truth that America, although the land of opportunity, is just has hard if not harder than a 3rd world country. Opportunities exists here, but you have to fight tooth and nail for it. He created a mess of his life and had what I want to say is a nervous break down.
My questions are;
1- How long can he remain out of the country?
2- Will CBP allow him back in with just his green card and US license (he lost his passport)?
3- Should I put money in his bank account, just to keep it active?
4- Also, removal of conditions is due to be submitted late December, early January. If he is out longer than that, what could be done about it? On a side note, he lost his green card in January and applied for a duplicate. The duplicate arrived two weeks ago and states expires 4/2017. But his conditional status ends 4/2016. Do you generally have up to a year to remove conditions? and if he enters after 4/2016 will they allow him in because the newly issued greencard says expires 2017?

4- removal of conditions must be submitted within the 90 days window of the expiration of the card. Not sooner, not later. They will not allow him back in if the card is expired or if he has been out of the country for longer than 6 months.

Try to call them tomorrow, ask for Level 2 agent, he/she should be able to tell you the exact day.
So I called them first thing this morning and he said that I'm "in line for the oath". I guess I jumped the gun. But he did say that it will be in August. Didn't let me speak with a tier 2 person, do you think that would have made a difference?

Just got an email that my oath ceremony has been scheduled!!! So excited! Let's hope it's not while in on vacation.

No oath ceremony scheduled for me yet . Kinda freaking out because at the interview he said that my oath can either be on the 31st of July (if I get bumped through the supervisor fast enough). If not, it would be sometime in the middles of August, with September being the latest.
Well... 31st is my 10th anniversary or arriving in the States, so it would have been really really cool if I could have became a citizen on that date, but seeing as that it's 10 days away, I highly doubt it will happen. I go on a week long vacation on 17th through the 22nd of August and if my oath is scheduled during those days, I will have to reschedule and be put at the end of the line. My mom is gonna be here through the whole month of August and I would have loved for her to be here with me while I take the oath...... But that's not how life works out... Sooooo boooooo. End of rant. And I'm super jealous of all yall that already got the Oath scheduled.

Question to those who have their oath ceremonies scheduled. Did the status change on the USCIS website or did you all just get a letter in the mail?

I told her everything this morning and I think that's what she's gonna do first. see if she can find a good divorce lawyer. thank you guys!

She will need a lawyer for a consult at minimum. She had a baby while married many states will consider it the be her husbands child, and it could be why the Judge did not grant the divorce the first time.
oh no! i hope that's not the case.. God forbid..
she would be devastated

The main thrust of your question seems to be divorce in TN and I have no idea how that works, surprised she can not get that information froma local divorce lawyer.
Immigration wise, a U visa?
she's been to an immigration lawyer and they said that there is nothing they could do if she doesn't get a divorce first.

I've heard of this thing called "divorce by publication". Is it possible to to in your state?
like when you put an ad out in the paper and if he doesn't respond within a certain time, you can't a divorce?
if so, we have thought about that....

Hi guys..
no, this is not another one of those threads where I'm asking for a "friend", when i'm really asking for myself to save the embarrassment. I really am asking for a friend.... so here is the story:
i have FINALLY met another russian person near me... turned out she had lived 5 mins away from me for a year... i haven't met a russian person in my area... oh well, let's just say NEVER! and here, by the grace of god, turned out that she was right next to me. Let me just point out that i'm very happy to have her around and we have become really good friends over the course of less than a month.
so.... here's the deal. she is out of status...which is not a big deal, i've been in her shoes, i know how to get that fixed, but there is a BIG problem.
she came here by work and travel program that is offered to a lot of college students, stayed, continued to work after her visa expired, lived a full life (which is more than i can say about myself when i was out of status). later on she married a guy, but he never filed her papers.
they split up eventually, cause he was a psycho and was mentally abusive, even broke into her house once, which she has the police reports of when she filed. anyways, she met another guy, they started living together, she got pregnant and now she has the cutest little girl ever. BUT, the big elegant in the room is that she can't do anything. she is still out of status, they can't get married cause her husband won't give her the divorce and the last time she heard from him, he was somewhere in Malaysia.
here she has this great life, with her child's father who supports her financially, and loves her, but they can't be a family, cause her husband won't divorce her and she knows that you can't be married to two people at a time. she drives without drivers license, doesn't have a state ID, doesn't have health insurance and can't be a fully functioning member of society. she volunteers at her church and does way more than i could have ever imagined to do when i was in her situation (i was afraid to leave the house, thinking i'd get deported hahah)
the question is, how can she get a divorce from her husband. i will walk her through the AOS and ROC and all that good stuff. i have thought that maybe she can file VAWA since she has proof that the husband was abusive and didn't file her papers. she had tried filing for a divorce with the papers that showed that the husband was absent, and the judge wouldn't even look at it. she lives in TN btw.
i really want to help her, i love her like a sister, because she is the sweetest person i've met and she deserves to live a full life with her family.
so please guys, all judgements aside, give me some idea on what to do next. a lady from her church contacted a PI to find her husband, but i'm sure there is an easier way to get a divorce from someone absent and out of the country.
