If I was the IO i would wonder how if you entered with the intent to have fun for a couple of months and had truly intended to leave when your visa was up how you could just change your mind and be able to stay without needing to go home first to end a job/lease, and take care of other personal stuff.
  2. We were sitting in the supervisor's office and even the supervisor was telling us we needed the unexpired green card. I even pulled up the USCIS website on my phone and showed the supervisor the combo card information. they were not budging
  3. i would think unlikely but you never know... my husband was denied boarding with a valid AP card - it was in 2013 when the combo cards were relatively new and we flew frontier airlines to cancun. They would not allow him to board with his Valid AP/Ead combo card. They said he had to have an unexpired greencard even though the combo card stated right on it valid for travel. After i made it back to the states i took it up with frontier airlines and the department of transportation. I was told in writing that the airline can and will refuse boarding if they believe it's at all possible that you will be turned away at the border. It was just one of those things where the airline employee was not familiar with the combo card yet so they didn't have to honor it. In this I guess it would depend on how educated the airline employee is on the rules regarding expired greencards- even then that only gets you on the plane.
  4. no interview for AOS or ROC ... its been a while - his N400 was in 2016. Yes i know stuff has changed since then. my point being there was a time when it was common to waive AOS interviews and honestly when i replied i didn't realize how long it had been - i had to go back and look at my timeline lol.... it doesn't feel that long ago but guess it was!
  5. hmm my husband came on K1 and the only interview he had was at the embassy for the initial K1 visa and then again for N-400. He did not have an interview for AOS or ROC, that was before Covid and Biden.
  6. i don't see how refiling the 1-130 and I-485 addresses the misrepresentation and fraud stated by USCIS. Agree with crazy cat - This isn't DYI .
  7. Not sure why you are asking for advice - it is obvious this was your intention all along. If you were planning on returning you would not have cancelled your job contract or your apartment. I have traveled many times to another country to see my husband's family and never once did i consider quitting my job or cancelling my lease before leaving for my trip. Good luck!
  8. I am confused ... you said you entered on a tourist visa and then "love happended" and you want to adjust your status without any worry of misrepresenting your intention. You have also posted on the same day about having a party before entering on a K1 visa. Can you please fill in your timeline and clarify where you are and what visa you are using because both posts sound to me like you are trying to get around following the rules
  9. This! Also, keep in mind your fiance will not be able to get a driver's license or a job until the EAD/AP is approved. While you want her to prove herself with snow angels don't underestimate how difficult moving to another country and leaving all your family and friends behind for an entirely new culture will be She will be homesick and will need your help and support to get thru it.
