Help Needed: Applying for Re-Entry Permit During ROC

Hi all! I'm hoping to get some advice from folks here on my wife's current situation. Due to her dad's illness, my wife needs to travel back to Vietnam during this time. While there are no commercial flights available, there are chartered flights by the Vietnam government for Vietnamese nationals. With the impact of COVID, we do not know if she'll be able to get a flight back to the US easily. We also don't know how long she'll be in Vietnam due to her dad's illness. I think the best thing to do is to apply for a re-entry permit before she leaves. Our issue is that she's in the middle of her RoC with 10 months left (expires August 2021) before the 18 month extension expires. My questions are:

  1. Will the re-entry permit be valid only until this extension? Or will she receive a re-entry permit with a 2 year expiration?
  2. If the re-entry permit expires at the same time of her extension, would it be better to just travel with extension notice and try to head back before 6 months stay?
  3. Are biometrics being processed for re-entry permits right now? Her AOS biometrics were applied to her ROC filing. Just wondering if anyone else has gone through this recently. We're trying to figure out when best to apply for the chartered flight as there may be a waiting list. We know that she shouldn't leave the US until biometrics are received for the re-entry permit. Our local office is San Jose, CA.

Thanks!

Future IR 5 application - Will my mom denied IR-5 under new public charge rule?

My mom had 10 years green card but she didnt want to live in the US at the time so she filed I-407.

Now she wants to move to the US to live closer with me and her grandchildren. How hard is it for me to file another IR-5 application for her? 10 years ago, filing IR-5 is piece of cake. Now not so much.

I heard that they might deny her IR-5 application because she deem to become public charge? Is it true that they can deny IR-5 application due to public charge rule? What can I do to help the application.

Her situation right now is 65, divorced, good credit score, own a house with me in the US, no US employment history, and butt loads of cash in Vietnam

Will I receive two appointment letters?

I received my appointment letter for CR1 visa for my wife. I have a second I-130 filed for her daughter with her own case number. Daughter is listed as ADDITIONAL APPLICANT at the bottom of my wife's letter. Will she get her own letter under her own case number?

I need to cancel our appointment and schedule for a later date. I've reviewed the instructions to do so on the website but I'm waiting to see if I need both letters (if this is the case) to reschedule or do I just reschedule for the Principal Applicant and bring the Additional Applicant to that interview.

AOS Interview not approved on the same day. What now?

Hello everyone,

Before you say anything, I know I'm crazy. I know I should take a deep breath, I should be more patient, I should wait longer. I know so many others are waiting much longer than I am. I know my faults. But I can't do anything else.

I applied September 2019 (My timeline is filled, minus the interview). Interview cancelled March 30. September 2nd, a new interview was scheduled. Interview date was October 7th (last Wednesday). It lasts all told 20 minutes. Very simple questions. Lovely officer. She even repeatedly complimented on how well organized all of my stuff was. I have no visa violation, and the only "record" I have was a parking ticket (which I even included in the original I-485 application). I even offered to submit any updated tax forms, payslips, but the officer says it's not necessary, since the I-864 was satisfied. She kept quite a few bona-fide evidence (100 pages or so). She even explained the conditional green card and how I can apply for naturalization after 3 years of receiving the green card, etc. At the end of the interview, she said (pretty much word for word): All she has to do was to run a background check, which she is not worried about, and if that clears, I should receive my green card in a few weeks. It's been a week. No case update and nothing else of the sort. Still says Interview Was Scheduled.

This whole thing has been extremely hard on me emotionally. Every progress in the process somehow just leads to another step back. My (extremely simple) RFE took 3 months to process. My first interview was cancelled, and I waited 7 months for this interview. This interview seemed like a slam dunk. And now I'm sitting here seeing other couples getting approved on the spot/within the day but me. I know everyone is different. Every case is different. But I don't know what went wrong, or was anything wrong at all. The only thing I can think of was that my husband wasn't super aware of the forms. I prepared everything and just explained the process to him and had him sign things. But he answered questions about our relationship without a hitch, and we had a nice conversation with the officer.

I hate picking up the phone to call anyone, cuz no one knows what's going on. I'm afraid that if I don't have a decision on the same day, I'll end up waiting till the bitter end. What should I do now, besides waiting?
