Hello VJers

I have a question about filling i-864.

My USC husband and I live with his mom. She retired so doesn't have any income except the SSA. My husband income is about $29K, good enough to sponsor me. He doesn't claim his mom as the dependent when he filed the tax.

My question:

1. do we count his mom in our household?

2. the house we're living is in his mom's name. she is also the account holder for all the utilities so actually we don't have any utilities like energy, water, internet, phone bills under our names. But we do have auto insurance, life insurance, joint financial like bank statements, car loan, credit card authorized user, etc. Is it good enough?

Vietnam is currently processing DQ from late May for October interviews. My DQ is June1 so an anticipate my wife and daughter will have thier interviews in November as long as everything holds true to form.

We are not going to move to the US until after the school year is finished so around June 1. I want to delay the visa issuance until January or even February. I was wondering if an option other than asking to reschedule the interview for a later date would be to go to the interview whenever it is scheduled and intentionally not do the medical exams for both of them. That way they can clear the interview but get 221g forms for both for the missing medical. As long as there isn't a time limit to reply to the 221g like 30 or 60 days we could wait to January, get the medicals done and then submit them on the 221g. Side benefit is the date of the medical would be very close to the visa issue date.

Is there any risk at all do doing it this way or should I just postpone the interview? According to what I read online all it says is to reschedule only if you have to because "rescheduling could result in a significant delay". I'd have basically seven months to reschedule before our planned travel date. I'm wondering if that is a safe amount of time to reschedule?

If the 221g doesn't have a time limit to exipre it appears to me that it would be safer since the interview has been conducted and all we would need to do is send in the medical reports. Anyone have any experience with this? The travel.state.gov webpage for AP isn't clear on this. I saw a reference to 30 - 60 days to reply on another site but it isn't a definitve statement.

Application fees for i-765 and i-131 filing concurrently with i485 after 10/02

Hello Everyone,

I have a quick question. I am almost done with all the paperwork for AOS from F-1 visa but just worried that cannot send them out before 10/02. If I send them after 10/02, is the fee for i-765 and i-131 still waived if filing concurrently with i-485?

HI All.

Quick question about insurance and retirement beneficiary information. Im USC and want to keep copies on the ready to show if asked or needed.

Can you just print them out from retirement accounts or do they have to be directly sent and or signed in some way by the companies or employer policy holders?

Child Removing Conditions Separately From Parent

My wife and stepdaughter's i-751 is at the Potomac Service Center now. My stepson came to the United States 5 month after his mother, so he will be filing separately. The i-751 instruction state -

"If you are a child filing separately from your parent, submit a full explanation as to why you are filing separately, along with copies of any supporting documentation."

His "full explanation" is that he was uncertain about immigrating until the day we said good-bye. We then had to make arrangements, schedule the follow-to-join interview at the consulate, and wait for my wife to get advance parole before bringing him to the U.S. Does USCIS want that story in a letter, or a simple statement saying, "I, SON's NAME / A NUMBER, am applying to remove conditions separately from my mother, MOTHER'S NAME / A NUMBER, because I immigrated to the United States 5 months after my mother and, therefore, was ineligible to be included as a dependent on her i-751 application."

Also, what supporting documentation are the instructions referring to? Do I supply evidence of a relationship between me and my stepson or do I resend the documents proving a relationship between me and his mother along with a birth certificate proving the mother-child relationship? I can provide school records (showing our shared address) and health insurance records, along with some travel records (boarding passes from family trips) and family photos, but certainly not the evidence of co-mingled finances, utility bills, and legal documents mentioned in the i-751 instruction.
