Hello everybody, Is it possible to initiate the CR-1 process in the USA, then spend a year in my spouse's country while on an unpaid leave from my US-based employer while waiting? Some specifics on our situation. I am currently living and working in California and my soon-to-be fiance in Vietnam. We have talked about getting married there early next year but don't want to be separated for 18+ months. I can get a one year unpaid leave of absence from my employer. I wonder if I could spend that time in Vietnam? I would have to give up my apartment here and use my elderly mom's address as my own, as I do not own real estate. Would some statement from my employer that I am on leave and plan to resume working in the USA on a certain date and my past income satisfy the Affidavit of Support? Otherwise would I be able to use my 401k/IRA savings (and mom's address)? Finally my 84 year old mom would have enough SS income and owns her house, so use her as a joint sponsor?

My case was denied after almost 4 years of processing. Delayed by covid and 221g appointment taking a year to schedule. Got word today from my senator who was helping with my case. The visa has been returned from embassy to USCIS and will be closed. I need to know what my options are...and ask for any advice. Right now it seems like moving to vietnam is the only option to try and build a life together.

Just reading about K4 visa Status: I'm a US citizen, Spouse in the USA with CR1 visa, has green card, SSN etc. Will request IR1 in 2023. Spouse has son in Vietnam under 18, unmarried. Filed I130 for him to immigrate to USA in March 2022. He was included in the original I130 filed to get her US visa but did not file for him. Should have filed for both at the same time but this immigration process is discovery learning. Question: Can I file a K4 application so that he can come to the US while awaiting the outcome of the I130 and subsequent required filings? If so, when can I start that process? After the I130 is approved or sooner?

I am new to this forum so apologies if this question has been asked before. My wife just received notice from the NVC that all the paperwork for her spousal visa has been accepted and that the next step is for NVC to send documents to HCM who in turn will schedule an interview. We had planned on returning to the US in August this year (on my wife's B1/B2 visa), but now having second thoughts. Does anyone know how far out they are scheduling interviews at present for spousal visa's? Thanks

I'd greatly appreciate your answers to my questions below: 1. Both my wife and I have dual citizenship USA - Vietnam. We both have 2 passports that are current and valid. My assumption is we both do NOT need to purchase any VISA to enter either country in and out, am I correct? I have never traveled with 2 passports before so I just want to make sure I do this correctly. 2. I have 2 kids that are both US Citizen as they were born in the US. I recently applied at Vietnam Embassy in the US to register them into Vietnamese Birth registry and was approved as both parents are Vietnamese nationality. However, I have NOT applied Vietnamese passports for my kids. They only have US passports. Does this mean I must apply for VISA for them in order to enter Vietnam? Thank you for your time!
