Hello helpful Visa journey friends,
Iam interested to know what experience you have had upon entry into the USA if you were initially a CR1 visa holder upon issuance but decided to wait to enter the USA past your two year wedding anniversary.
Upon entering USA did you need to tell the immigration officer anything about the two year rule? Show your marriage license? Did you need to have this discussion about your new eligibility as a permanent resident vs conditional? Or was it automatically in the system? Did he comply or tell you he can t help you?

interested to know what your experiences were. Thank you!

Submit RFE response by mail AND online?

Hi all,

I asked this same question at the tail end of topic I started in this forum, but I think it deserves its own thread and sincerely apologize if it doesn't.

Long story short, we received an RFE to provide 'Evidence of a shared marital life together'.

The RFE states they must receive an answer by December 22nd, 2022.

We put our response together and mailed it via USPS Express mail. We have the USPS receipt and it says the package was signed for back in late October 2022. No other details like the name or initials of who actually received and signed for it.

If we don't see any status update through the USCIS online portal by, say, December 15th or so, should we prepare a digital RFE response of the same content and upload it to them? That way, we can at least have a digital trail and screenshots we submitted on time.

The last thing we want is for USCIS to say they must not have received it and there's no particular employee they know of, who accepted it. Maybe I just don't know how USPS Express works, but not having an actual person's name or initials who signed for it, makes me nervous.

Would you also submit your response online if the time is ticking down without any progress updates?

We used Rapid Visa up to this point, so they've always mailed things on our behalf.

Sponsoring US Citizen Spouse used Maiden name on I-130 application. How much trouble would this cause?

Our immigration attorney used my my wife's (US Citizen) Maiden name based on her Form N-560 Certification of US Citizenship before her first marriage. We had to call our attorney through Zoom to arrange for my I485/I130 application due to the Pandemic, mistakes happen.

She currently using her first husband's last name and kept it since even after the marriage with me (Applicant for Adjustment of Status) to avoid complication due to name change (all of her business and bank account document used the first husband's last name, and Covid really made everything difficult).

We have documents to show that her last name changed (marriage certification & divorce certification with the first husband). Would this be enough to avoid complication? I'm currently talking with our immigration attorney, but I want to ask for your opinion as well.

Hi All,

Just found out my wife is pregnant with our 2nd child. Our oldest will be 2 next month.

My wife is from Vietnam, and is a citizen. She wants to bring her mother over to help with the children.

Her mother suggested my wife and son should go there so she (and rest of family) can take care of her, but I don't like the idea of the baby being born there. Not to mention

my son being there and not learning (or hearing) English for a period of time. Wouldn't there be a huge hassle to get the baby back to the USA?

Need some guidance/suggestions please.

RFIE while living abroad

So I've been living abroad with my fiancee. When I first filed the K1, I used my mother's address in the US just in case something like this happen. So after receiving the "Request for Initial Evidence", I had my brother scan and send me a copy of the notice. I have already gathered the documents, however on the notice it says to send the original notice along with the evidence. The original is of course half way across the world from me right not. Some years ago I remember that my brother sent a copy of the notice instead of the original and they accepted. Will I have any problems because of it ?
