Hi everyone,

I recently received a Request for Evidence (RFE) regarding the I-864 form. As my mom, the primary sponsor, does not meet the income requirements to sponsor me, I included my sister as a joint sponsor. Unfortunately, I forgot to attach her W-2 and 1099 forms, which demonstrate her financial contribution. Consequently, I received an RFE requesting the tax supporting documents for my sister's most recent year. I submitted my I-485 application in August 2022, and during the period from 2019 to 2021, my sister earned enough income to support me. However, for the most recent tax return in 2022, her income does not meet the sponsorship threshold. Being self-employed, she has claimed various deductions related to house depreciation, resulting in a significantly lower tax amount. She can provide bank statements as proof of her rental payments from her properties.

I have a few questions that I would appreciate guidance on: Should I only submit her tax supporting documents for 2021, or do I also need to include the tax transcript for 2022? Is it necessary for my sister to write a letter explaining the reasons behind her lower income in 2022, despite having enough funds to sponsor me? Considering I already have one joint sponsor, should I seek another joint sponsor? And if I attach another I-864 for the second joint sponsor, do I need to provide an explanation?
I am feeling overwhelmed with these concerns, and any assistance would be immensely helpful. Thank you for your support.
Please find the attached RFE letter below.

Lawful Permanent Resident mother sponsors for unmarried 21+ daughter

Hi everyone,

my mom is going to sponsor for my sister (28 years old) and her son (4 years old) to America.

i have a few questions

1. My sister divorced in 2021, should she include divorce degree or just make a Single Certification by local authority?
2. On my sister s birth certificate. Her full name is written accurately but my mom full name is not correct.

her full name On green card is:

first name: T T N

last name: D

but on my sister birth certificate, it shows

first name: T N (T is dropped)

last name: D

do you think if we need to make a new birth certificate to match with my mom full name or we can apply with what we have?
since the birth cert was made 28 years ago, so I m not sure why it was short a middle name.
And if someone has a recent checklist of what you submitted, please share to me. I m much appreciated for your input.

Thanks

My wife who came over on a K1 Visa is applying for her AOS, and I am the sponsor but don't meet the income requirements so I am having someone else as a joint sponsor. When and if we get confirmation for our interview, does the joint sponsor also need to attend?

Re-establishing a US domicile - but we live overseas!

We are awaiting USCIS approval since Oct 2022. The I-864 FAQ says:
"A sponsor who is not currently living in the United States may meet the domicile requirement if he can submit evidence to establish that ... the sponsor intends in GOOD FAITH to establish his domicile in the United States no later than the date of the intending immigrant s admission to the United States."
AND
"He has taken CONCRETE STEPS to establish a domicile in the United States and will do so concurrently with the applicant no later than the date of the intending immigrant s admission."
Once I have my visa, we would naturally like to travel together and find an apartment when we arrive in the US.
QUESTION: What will be considered sufficient evidence that we intend to follow this path in GOOD FAITH, and what CONCRETE STEPS do we need to show to fulfill the domicile requirements?
We worry that we won't be able to provide the data the NVC officers are looking for.
The alternative would be a hardship for us: for my husband to move to the US before the NVC submission, and pay rent there living alone, while I continue to maintain housing expenses overseas. Since we estimate at least 4-5 months before I arrive, that is $5000 extra just for US rent, utilities, etc.!
MORE INFORMATION:
Since our marriage in 2016, my husband has lived with me in Vietnam. Even so, he has maintained his domicile by:
1. Paying the US state and local taxes
2. Maintaining his bank account in the US.
3. Using his aunt s permanent address, and a US virtual mailing address (since he sold his house in the US in 2020)
4. Having his private doctor
5. Having renewed his US. driver s license
6. Writing emails to his friends about our upcoming US return when I am issued a visa.
7. Visiting his aunt in the US every year, except for the period of COVID-19 lockdowns
He also composed a letter mentioning that he has a concrete strategy to establish a domicile.
He said that when we arrive in the US., we will stay in his aunt s house temporarily while searching for an apartment.
Thanks for reading and helping me with this issue!
