US Immigration from Vietnam

Hello,

I just want to verify whether I am thinking correctly.

I have lived several years outside of the USA although I have maintained houses in the USA (one rental and one my brother is living in while I am away), personal bank accounts, business bank account and LLC, mailing address, US state licenses for my field (health related), etc. But I have filed FEIE and I have not been in the USA in years.

My thought is that I am domiciled outside of the USA since I have been living abroad for about 7 years (though a short, early part of that time I was employed by the federal government) and I need to note that and show evidence of my intention to reestablish my domicile in the USA.

Can anyone clarify if I am thinking correctly or if I am wrong and I am domiciled in the USA based on maintaining what I have maintained there?

I have a question for a friend of mine. His Brother is a US citizen. Can his brother file an application for him to move to USA? They are both in their 50's. And my friend here in Vietnam has a wife and daughter here.

So does he just file an I-130 for each of them? want to make sure I explain it to him properly. Thanks in advance for any kind help.

On the US Consulate in Vietnam website https://vn.usembassy.gov/visas/immigrant-visas/required-documents/ which list required documents to bring to the interview it lists all birth certificates for petitioner and applicants.

8. Birth Certificates: Copy and original birth certificates of the petitioner, each person listed on the application, and all children of the principal applicant (even if he or she is not accompanying). In case you do not have the petitioner s birth certificate, the officer will review the case and provide guidance at the interview. If you or any children were adopted, you must submit an official adoption decree.

I'm the petitioner. I have a copy of mine, but not the original. Everything else is fine. We have all other docs. I live here in Vietnam and will be going to the interview. The question I have is the somewhat cryptic statement above that says "In case you do not have the petitioner s birth certificate, the officer will review the case and provide guidance at the interview. " What does this mean? If everything else besides this looks perfect and above board do they waive this request? If I really need to have it I can have a copy sent, although it's a pain. Just want to know if this is a big deal or not.

My wife's CR-1 application recently got moved to the NVC stage and I am working on my wife's DS-260.

From the period of 2007 until 2013 my wife lived in several places in Ho Chi Minh city but does not remember the addresses.

Her home town is Thanh Hoa.

I understand that the best answer is to try to remember, but that does not appear to be possible.

What should we put for those years?
