Hello,

I m trying to help a friend to bring her daughters from Venezuela to Puerto Rico. She recently became a Permanent Resident.

Key points about her case:

* She came on a K1 visa this year. Her daughters were included in the petition but they decided not to follow her.

* She got married on May 2019, which would make her 17 year old eligible to be petitioned as a stepchild of a USC .(if I understood guides here correctly). But not her 18 year old who would be 19 on December this year.

* Both daughters graduated from high school and are unmarried and without plans of doing so.


* She wants to reunite with them and preferably not having to choose between bringing one and leaving the other all alone.


I have a few questions:

- Can she petition for her daughters with a conditional green card? If so, can she rely on her husband s income and/or use her husband as a co-sponsor for her daughters?

- Can her husband petition for her 17 year old and she petition for her 18 year old? Is there any advantage in doing so?

- I know all those processes take a while, but how can she check the priority dates and have an estimate on how long it would take?

Last but not least, what would happen if her daughter turns 21 while her application/petition is pending?

I m aware that the best route for her was to bring them with her as k2s, but that s water under the bridge now. :(

We just had the interview in Detroit. Is it normal to NOT be told if you are approved at the end of the interview? He just said he would have to review the paperwork and had us sign something that said it could be 60-90 days. His questions were not deep and were all quite surface. All questions were answered properly without any issues. I didn t hold her hand or hug her or kiss her during the interview. Is that a problem? I didn t want to make it look like I was trying to prove something. I am nervous, to be honest. I figured they would tell us we were approved right there.

Hi, my son was born in 1997 and at the time I could not request a Foreign born birth certificate because of the following rule:

- The parent must have lived 5 years prior to the birth of the foreign born child,, of which 2 years must be after parent's 14th birthday.

I was born in the US but my parents moved abroad before I was 14 years old, and I lived there until I was 22 years old. At 22 I moved back to the US and have lived here ever since. I am 40years old right now.

My son is born out of wedlock. I sent his I130 when he was 16 years old, and got approval and visa number when he was 17. After all the delays and DNA test my son finally made it to the US when he was 20 years old.

We recently applied for a US passport but they are requesting an affidavit for my address when I lived abroad and they are asking the same thing as the birth certificate abroad "parent must have lived in the US at least 2 years after 14th birthday" which I don't understand, is it 2 years after 14 years old at ANY time, or AT the time my son was born.

I'm about to hire an attorney only because USCIS makes it so difficult to understand the requirements. I also thought my son would automatically be a US CItizen once he is in the US, or is that ONLY if he is under 18 years old?

K1 Questions

Okay so we filed our K1 paperwork and I just got notified today from USCIS they received it and a Form I-797 was being sent to me via regular mail. My fianc left the USA first week of September to go back to Venezuela after being here 3 months and will return mid January 2020 after being gone 4 months. She has a B1/B2 VISA and last time she was here immigration stamped her passport for 6 months but she didn't stay that long. When she goes thru immigration should she even say we have applied for a K1? She is basically staying here (no longer then 6 months) until she has to return to Venezuela for the physical, the cleared police report and her K-1 interview is scheduled in Bogota, Colombia.

My plan was to buy a roundtrip ticket have her arriving in mid Jan but returning in April or May, but what if the immigration guy in the USA says oh you can only stay 1 month because you were just here 4 months ago? From what I have read there just isn't any rules on this. What will help so she can stay 6 months?

Hi guys, my fiancee is from Venezuela and she is currently residing in Quito-Ecuador, her immigration status in Ecuador is illegal.

We already met each other and I am planning to file a K1 visa on her behalf, but my concern is if her immigrant status in Ecuador will affect negatively on her visa application and if it will be reason to be disqualified for the K1 visa, she will have to have the interview in Bogota? Please if someone can give me the right advice and clarify my doubts. Thank you!!!

PD. I need to hire a lawyer to file this application? they are really expensive.
