CRBA for baby being born in October but still in the NVC processing phase.

Hey everyone,

I have been trying to find more information about the CRBA and what the exact process is but it feels like I might be in a bad situation.

I was staying with my wife in Ukraine before Covid happened and I came back to the USA in February for a quick visit to renew my passport and visit my parents. However, covid happened and I got stuck in the USA not being able to travel back to Ukraine. A week later my wife found out she is pregnant.

We have been going through the CR1 process since August of last year and we are in the NVC stage waiting for our case number to be created.

Firstly I'm not sure if Ukraine will let me travel there by October when my wife is due. However, if I am allowed to travel by then how much time would I need to apply for the CRBA and be able to get the baby a US passport so we could travel back to the USA once my wife's CR1 is approved?I'm worried I won't be able to stay there long enough because I am working full time now in the USA so I can have health insurance and more money saved by the time my wife gets here.

Is it also true the baby needs to go with me to the embassy in Kyiv? My wife lives on the western border with Poland and traveling to Kyiv with a small child would be very difficult especially since I won't have much time in the country and the baby will be newly born.

I'm worried that I won't be in the country by the time we can travel to Kyiv and then we wouldn't be able to get the baby's documents done in time before her NVC approval expires (assuming we have one).

Am I screwed here?

Hello all,

I couldnt find if this specifically was answered before, but being that "School starting" is a reason to expedite a visa, does a child listed on K2 with my fiancee's K1 a valid reason if I can enroll them in school in United States and provide documentation? It's not specifically listing college aged students, but I also wasnt sure if expedited process also pertains to K1/K2's.

The county is Ukraine. I will try to contact them, but thought I would check here as well.

Thanks in advance!

kyiv embassy open?

My fiancee went to get her medical done and was told to get direction from the embassy first before they would do the exam. She said she went to the embassy and it is closed for the summer. She said the visa office was open though. Is there any reason why she needs to go to the embassy before the medical? Is the embassy in Kiev really closed now still?

Has anyone else heard of this happening?

3 Year Rule clarification

My wife and I (US citizen) went through the standard K-1 Visa process. She arrived and we were married in August 2017. She received her conditional Green Card in May 2019.

The way I read the instructions, we now have to wait two more years to start her citizenship application because the 3-year rule starts from the time of becoming a Permanent Resident (receipt of green card). Am I right?

I wouldn't even ask, but she has two separate friends who also did the fiancee visa and are now citizens, but they both say that their Three Years started from the time they got married to a US Citizen and have been living in the US. In other words, they only waiting three years from the wedding, not three years from becoming a green card holder.

I keep looking for information that confirms this, but I only see confirmation of my view. Who is right?

My wife is looking at me like I'm an idiot -- she believes her friends.

TIA
