Questions: Concurrently filed I-485 for K-2 rejected

Hey all,

We sent the AOS packet for both my wife and step-daughter together. My wife's part of it was accepted, but the portions for my step-daughter were taken out and sent back with a Rejection Notice.

Based on the letter below, what I'm guessing was missing was that they wanted a copy of the I-129F packet as with the approval stamp on it. I'm assuming this because even though I sent in two copies of the I-797 for the K-1 approval, the I-797 doesn't actual mention my step-daughter's name on it anywhere. The I-129F packet, on the other hand, does.

I had a few questions that I couldn't find answers to across the forum:

  • Is my above assumption correct? They want a copy of the approved I-129F?
  • Now that the packets have been separated, is this no longer a concurrent filing? Does that mean I have to pay $1140 for my stepdaughter instead of $750? (she's under 14)
  • They tore open the I-693 envelope. I'm really hoping this doesn't mean we have to get a sealed med exam again (she only did the vaccination worksheet part). It looks like all the papers I sent them were scanned in (they have serial numbers and timestamps lightly printed at the bottom of each page now) so maybe that means the information is in their system for those documents?
  • They returned the singular copy of the marriage license record I sent in for both applications, but they didn't return the Affidavit of Support. To be safe, I'm thinking I should probably send a new one in, right?

We are getting married within a week or so and originally wanted to start working on all the forms (4 different ones?) so we could immediately file. Didn't happen because we've had too many other things on our plate. Is there an online service that isn't as expensive as hiring an immigration attorney would be to file all these forms? Also, it appears there's a separate form to file if my fiancee wants to be able to travel internationally. It's a bit confusing what the rules on that are. Lastly, I assume she should also apply for a SS# as soon as we get married so she can get a permanent driver's license, as hers expires September 11. So many questions! I sure hope this eventually gets easier.

Biometric appointment scheduled, still have to respond to RFE?

July 24, 2021 Biometrics Appointment Was Scheduled

July 14, 2021 We sent a request for initial evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status.

July 9, 2021 We received your Form I-485, Application to Register Permanent Residence or Adjust Status, and sent you a receipt notice.

Do I still have to respond to the RFE if the biometric appointment was scheduled?

What is weird, the RFE I received is pretty much the generic one as if I did not submit an I-864. Which I did, with all tax documents, W-2s, proof of citizenship, etc. I don't know what I did wrong, so I'm just going to complete the form again and submit. Having some trouble submitted the evidence online tho, keeps saying try again in a couple minutes. Any advices?

VJ,

If there is a link available for my situation please advise. Okay, so my wife has her first Green Card which expires in November of this year. She went back in Feb 2020 on vacation and was stuck there for all of 2020 and part of 2021, (then had to have surgery). My two questions are: 1. is there a "remaining time on the green card" for her to return to the US? 2. Are we able to renew/apply for her second green card while we are dislocated. We are hoping for a Sept/Oct 2021 after she recovers from a semi-serious surgery she just had. My concern is that immigration is going to give us a hard time for the length of time she has been gone.

Thanks everyone

Gary
