Title says it all. My CPA filed me as single even though I m married. My understanding is that even if your spouse isn t an LPR or citizen you need to file as married filing separately. Now I can get the amended tax return, but IRS is currently taking 4 months to process them and my time to file for NVC will like come sooner. And if I do amend it, I assume I can t use the old one to file for NVC sooner . Anyways, is it worth it to Amend? Would the NVC dislike/and or care that I filed as single even though I m literally going through this process married? Also, the most important part is with the consulate when they review the I-864 documents and financial documents and see that I m separating myself on paper from her in my taxes? In my mind I could easily see this becoming a reason for them to think the relationship isn t bona fide, although I will probably have a joint sponsor of some sort.

Hello, So long story short, I m only 20 and have made very little income up until this last year (2022), and even that income is hard to prove since it was from day trading crypto. I m having trouble finding a joint sponsor who will commit for me. Anyways, I do have a significant amount of cash and properties in trust for me from my family. If I were to have them transfer ownership of such assets (CDs, bank accounts, properties, and so on) to me, how much value would I need? I know atleast one house I would get is worth around $150k, and in addition I could get cash. How much would I need? I saw somewhere it says 5 times the amount of missing income. Would that mean 5x~$25k since I would report no income? Also, would they even be likely to accept it, especially if it was just transferred to my name? Thanks.

Hello, my goodness what a stressful week it s been. Now that I m going back and looking at the documents my lawyer submitted, I m realizing there some huge possible errors. Well, here s another one: on the I-130 he listed her as unemployed. On the I-130a he listed her as employed with her current employer. Both documents were signed at the same time. Will we get RFE for this? Is there a way to correct it before we get RFE? I also noticed for the address in the I-130 and I-130a, I had tried getting him to put all the address we re together when we visited each other, even hotels. However he missed all but one, so there s only one address showing that we were together for less than a month. (We have some other evidence showing we were together at the other places together) I can t believe I trusted a lawyer would cross check things. Honestly, I feel like I do a better job at cross checking things and should have never left it in the hands of someone else. Anyways, will these two things, specifically the first one cause an RFE?

Hello, I m using this opportunity to ask two questions in one. The first one is more important, and perhaps a problem. We filed our I-130 in December 2021. I don t remember if there was a section asking if she previously applied for a visa to the United States. If there I was, I m quite sure I answered no (but is there even a place it asks that?). The reason I m concerned is because I totally forgot about a year before applying for her I-130 we had applied for a B1/B2 visa for her to come the United States. We had filed out a DS-160 for her, paid the fee, setup an appointment, but then cancelled the appointment since we decided to just visit each other in a third country. Is this considered an application? Furthermore, was there a place I was supposed to declare this in the I-130 or any other USCIS application/form? the second one question is: I m moving back to America next month after living abroad for 11 months. I kept my US address, paid all my normal bills there, and so on but just lived here. When I got back, it will be getting close to the time to apply for the NVC. Would I need to establish domicile if I just got back from living abroad? Thanks all for your answers! This just came to my mind about the B1/B2 visa and it s really scaring me!

Hello, I filed in December, 2021. I haven t heard anything from them (no transfers), and when I check the receipt number it still shows the same message that the notice was sent and they received my application. I ve seen some other cases on this forum that got an update that it was being reviewed only a few months into their case and they still have not been approved. My question is: is it usually an indicator of how far off your case is from being approved? Would it be a bad sign/an indication that it won t be the normal processing time if it still shows the notice sent message? What is your guy s experiences? Thanks
