Inquiry for case being outside normal processing time

Dear VJ members

My husband submitted an inquiry the other day because our case is now "outside normal processing time".
Can you tell me what we can expect from USCIS? Will they actually make a decision when looking at our case (due to the inquiry), or will we just get a random feedback from them that they're still reviewing our case? What is y'alls experience? What happened after you submitted such an inquiry?

Thank you very much for your feedback!

President Donald Trump said Monday that he is temporarily suspending immigration to the United States in response to the coronavirus pandemic and the "need to protect jobs." In a tweet the president attributed the suspension to an "attack from the Invisible Enemy" and the "need to protect the jobs of our GREAT American Citizens."

My husband and I waiting on the I-130 petition to get approved. Did you this also gonna affect the spouse/family visas?

Who all needs to fill out an I-864 AOS form?

Hi all,

Since we re hoping to get our petition approved soon, we re starting to look into what things we need during the NVC process.

Since my husband and I both live in Switzerland and he s currently studying, we ll need to have a joint sponsor which will be his dad.

Now we re wondering, who all needs to fill out an I-864? Only my husband (primary sponsor) and his dad (joint sponsor), or also his mother (married to his dad and the two have one household). His dad covers the 125% by himself easily.

Also: Will each one of them have to fill out a form for me (the spouse) as well as for my son (stepson)? Or just one form for the two of us?

If one per person, I assume we write 1 where it asks Persons you are sponsoring in this affidavit ?
And then how are the household members calculated? We thought that for my form, I d be the person sponsored, so 1.

- 1 my husband

- Wife doesn t need to be listed again since sponsored (?)

- 1 our daughter (US Citizen) as dependent child

But what is with my stepson? It asks for persons NOT sponsored in the Affidavit. So would he be entered as dependent child as well?

basically we re a four people household including the two beneficiaries - me and my son.

And how would my father in law calculate?

Only his wife lives in his household, but then my husbands brother is still a dependent child as he s in college (he s over 21 and lives 4h away though). So I guess he d write himself, his wife and one dependent child, right?

Thank you all for the help!

Question - Out of the US for a few years

Hi, I'm looking for advice on what to do...
You can find more on my timeline, but I just got the 18 month extension letter for my greencard.

My wife and I will have a newborn in June and we decided that we will have him in the US but start raising him in Switzerland when it is safe for him to fly (probably end of October) and stay for at least a few years.
This decision is mainly based on the fact that in Switzerland I will be able to make more money and my wife will take care of the baby.

We will be able to fly back to the US whenever if needed, keep a bank account, and continue to file our taxes in the US.
We will for sure come back once a year for Thanksgiving or Christmas.

What is my best option to leave me the option to move back to the US ?
Should I fill a I-131 (Reentry Permit) even if I think that I won't live in the US for more than 2 years ?
Should I inform USCIS ?

Anthony

Advice on filing an I130

Dear Visajourney users,

Thank you so much for your precious help always!

I am looking for some advice with regard to requesting a IR1 visa. My wife (USC) and I (Italian) live in Switzerland and wanted to apply for an IR1 visa. We started working on the I130 but in the meantime the pandemic started and we thought to hold on as the economic situation in the US might not look good by the time our visa is granted.

We discussed this with a lawyer who suggested to start the I130 process as it takes about 6 months to be approved and after that there is a one year period to send the request to the NVC.

What happens if we miss the one year period? If my understanding is correct, after the one year period, the I130 is sent to the NRC and we would need an i-824 to pull it out again. However, I-824 processing times seem to be quite long (8 months?)

Is it worth going through the I-130 process now and potentially needing to file an I-824 or would it be better to start the whole process when we are sure and ready to move to the US?

I know this might sound like a matter of personal choice, but this forum is always full of great advice and people with similar experiences, so I thought I would ask!

Thank you in advance for your help!
