Expect More Lawsuits And Restrictions On H-1B Visas In 2020

The year 2020 is unlikely to be an improvement over 2019 for companies that hire foreign-born scientists and engineers on H-1B visas. Companies should expect 2020 to bring more restrictions.

An H-1B is generally the only practical way for an international student or a high-skilled foreign national educated abroad to work long-term in the United States. Under Trump administration policies, denial rates for H-1B petitions for initial employment (primarily new employees) quadrupled, rising from 6% in FY 2015 to 24% through the third quarter of FY 2019, according to a National Foundation for American Policy analysis. The 12% denial rate for continuing employment [mostly for existing employees] is also historically high 4 times higher than the denial rate of only 3% for H-1B petitions for continuing employment as recently as FY 2015.

In a stable policy environment that adheres to the law and regulations, H-1B denial rates should be extremely low, since, given the time and expense, companies and attorneys only submit applications for individuals they believe meet the legal requirements

Me and my husband filed for my AOS a little over two weeks ago. Yesterday we FINALLY received the text saying our case was received and that we will get I-797 in our mail soon. However, when I put our receipt number into myUSCIS it only shows that I ve filed the I-765 (employment authorization). It doesn t show the actual AOS not the AP. Has anyone had the same experience? I ve checked back every couple of hours or so but it doesn t change. I ve also tried calling USCIS but it s just an endless loop of recorded messages. I ll submit a picture of what it looks like:

Hi everyone! I could use your support right now... My medical exam is scheduled for December 12 and my interview on December 18. Now, I have received the unfortunate news from the embassy in Stockholm that I need to register my marriage here in Sweden as well, for it to be reflected in my "personbevis" (a civil document containing information about your birth, family, address/ domicile, etc.). This is what the embassy said:

"Please note that your personbevis should reflect correct marital status. Upon receipt of the new personbevis please upload into CEAC and bring original for the interview."

I had no idea I needed to do this, especially as we do not plan on living in Sweden and we got married in and intend to live in the US together. There was no information about this component as a requirement for the submission of civil documents to the NVC. The worst part of it all is that it takes 3 months (!!!) to register this information and to update my marital status in Sweden. Also, adding an additional procedure to this already annoying process, it will take a few weeks to apply for and receive the new civil document containing this updated information.

Is there anything that can be done at this point or do I need to cancel both my medical examination and my visa interview? I am so sad, having waited for more than a year now and was so excited for the final reunion with my partner.

Thank you!

I served in the military (did training and joined the home guard) and I will obviously answer yes to that question. Do I also need to submit records of the military service? I already sent them stuff for that when I applied for my K1 visa as well as my AOS and the instructions only says "You may also provide evidence to support your answers" but it doesn't say I have to...
