Hello,

I am filing I-751 for my 6 year old step son as he came 1 year after my spouse (his mother) to the US. I have a couple of questions and thought maybe someone could help out.

Part 1 I put in step sons information

Part 2 I put in steps sons information

Part 3 I have checked 1b.

Part 4 I put in my information the (USC)

Part 5 is left empty (as he is only 6 years old)

Part 6 I checked all no

Now to the confusing part.

Part 7 Petitioners statement.

What to check here? I am thinking 1a. But the statement they have for 1a would not apply to my 6 year old step son as he just started 1st grade and does not understand the petition application nor speaks perfect english. Or is this more directed to the person that will sign the petition instead of the child.

Who should sign instead? His biological mother or can I sign as the step father(USC).

Part 8. I will sign as I am the individual in part 4.

Should I also fill in Part 10, as it is not the petitioner that is filling the application, and put my information. Or would this be more directed to a 3rd person outside the family.

Any insights would be greatly appreciated.

Hi all,

A little backstory, I came to the US as a J-1 and stupidly got married at the end of my year to my then boyfriend. Long story short it didnt work out between us and I never ended up filing AOS packet with him, therefore ending up "out of status" for over 2 years. Met my now husband, finalized divorce, got married again and now we have our interview coming up.

My question is are they going to bring up my first marriage at the interview? And will I have to bring evidence that that marriage was bona fide too even tho I never filed for a green card?

U.S. to start collecting DNA from people detained at border

HOUSTON -- The U.S. government on Monday launched a pilot program to collect DNA from people in immigration custody and submit it to the FBI, with plans to expand nationwide.

The information would go into a massive criminal database run by the FBI, where it would be held indefinitely. A memo outlining the program published Monday by the Department of Homeland Security said U.S. citizens and permanent residents holding a "green card" who are detained could be subject to DNA testing, as well as asylum seekers and people entering the country without authorization. Refusing to submit DNA could lead to a misdemeanour criminal charge, the document said.

Dec. 30 is the deadline to submit a comment to the U.S. Citizenship and Immigration Services over a proposed fee hike to access some records, some of which date back more than 100 years and are useful to genealogists.

The USCIS wants to increase the fee for obtaining immigration files by 500%, which means some people would have to pay more than $600 for the documents. The move would affect families of the millions of people who immigrated to the United States in the late 1800s and early 1900s.

"This is immigration history," Ren e Carl, a genealogist in Washington, D.C., who works with clients who use the records, tells NPR's David Greene.

"If someone is coming from a displaced persons camp in Europe, they would have filled out all this paperwork while still in Europe," Carl says. "Then you get the information on when they come in. You get a photograph if there's a visa file. You almost always get a photograph."

There are millions of records held at the agency, Carl says. These include alien registration files, files for certificates of naturalization and visa files, if one applied for a visa to come to the United States. "There might be something called a registry file if, during the process of naturalization, the government couldn't find you on a ship manifest, so they were trying to document how you entered the country in the first place," Carl says
