Hi,

I am new here and I am trying to find out if my husband can enter U.S. without any problem.

It is long story and we were expecting to get the letter that he is eligible to file I-601 but, he received the passport with VISA!

But, we still concerned if they will let him enter to U.S. because he previously overstayed in US and under 10 year bar and it is only over 2 years after he left.

Here's summary of our journey

He got caught by DUI and had to choose voluntary departure at ICE. (2018)

After I got my citizenship in Jun 2019, we filed I-130 and it was transferred NVC for consulate processing.

It took long time but we had an interview before covid 19 was getting bad at the end of Feb. The lawyer told us that we will get the waiver recommendation letter.

The officer gave him blue letter and it was marked that he need to mail his passport and panel physician's evaluation report.

After we did everything required, we thought we will get the waiver recommendation letter.

However, the lawyer received my husband's visa with IR-1 VISA on it!

I wish it is not a mistake but i don't understand how he could get it without i-601 waiver. We were actually preparing i-601 packets to file.

Anyone heard about any similar case? and you guys think it is okay him to come to US?

Hi everyone,

I received the following message on Mar, 31, 2020:

The National Visa Center (NVC) received your fianc (e) s/spouse s approved I-129F petition from U.S. Citizenship and
Immigration Services (USCIS). NVC will now forward the petition to the U.S. Embassy or Consulate in Seoul, South
Korea. Please note that the transfer process can take several weeks. The U.S. Embassy or Consulate will contact your
fianc (e)/spouse when they are ready to process his or her petition.

It's now May and neither of us have received any kind of update regarding an interview or next steps. Is there anything else I should be doing? It may just be due COVID19 stalling the process but I wanted to make sure. I do not have an invoice number and when I track the case using the CEAC website, the site tells me the case is still in transit.

Hi everyone,

I had a question about AOS through INA 245i LIFE ACT

Key info

-My mom who petitioned for me is a LPR not USC.

-I entered legally on a tourist visa when I was young.

-Currently DACA recipient

Oct 2015: my mom (LPR) filed a i-130 F2B for me (daughter over 21)

April 2020: I got the i-130 approval letter, but it stated I am not eligible for AOS from the documents I provided. Im assuming this is because my mom is only a LPR and it does not forgive overstay. They are sending my documents to NVC for consular processing. However I wont be able to go through consular processing as I have accrued 1+ years of unlawful presence and will incur a 10 year ban if I leave for the interview.

My lawyer asked my mom if she had filed any petitions under the 245i act. Her old employer actually petitioned a i-140 for her before the cut off date. We don't have the records so I submitted a FOIA (freedom of information request).

My question is - if my mom actually has record of the i-140 that was filed under 245i, would I be able to adjust status through that as a derivative beneficiary?

Any insight would be greatly appreciated!

Hi folks,

So I have a serious American girl friend that I have been dating for about 7 months. I just graduated from college on F-1 and now I am currently staying in the states under OPT, which grants me 90 days to look for a job (my last day under OPT is right around May 20th). Because of the coronavirus pandemic, my job searching has been extended a lot longer than expected and me and my girl friend decided to marry a bit earlier than we had planned. I have researched what I needed to do in terms of getting a marriage license. However, when it comes to documents and deadlines regarding immigration, I am a bit uncertain. I read from https://www.uscis.gov/sites/default/files/USCIS/Resources/A2en.pdf that I'll be needing I-130 from my spouse and I-485 from myself. My question is are I-130 and I-485 all the documents that are needed? and do I have to be approved before May 20th? or can I apply before my last day to not breach any immigration laws? Thanks a lot in advance : )

I-751 with RFE, want to separate

Hi,

I have filed I-751 in January 2019 and I just received RFE couple weeks ago. I have no idea what options I have at this moment

We didn t have a strong evidence (even though my AOS was approved on the spot) when we submitted I-751 because of certain situations which was explained when I filed it. My usc wife has horrendous credit (we are talking about in the 400s) and few criminal charges (couple misdemeanor theft) make it almost impossible to put both our names anywhere. She couldn t get a car financed so my car is only under my name. She won t be able to get an apartment lease because she has horrible credit on top of criminal history. She can t be on my car insurance because she wrecked a couple cars in the past (insurance literally quadruples if I add her as a driver)

I have submitted

-3 affidavits proving bona fide marriage

-a lot of pics

-life insurance, her being the beneficiary

-couple utility bills together

-joint tax returns, bank accounts and driver license with same address

i just can t find a way to strengthen the case. She has been using a separate bank account but still uses our joint account (she gets her paycheck deposited elsewhere). I thought it was odd but in the end, I discovered she was cheating on me and on top of that she uses my immigration status as a leverage and I just have to understand what s going on.

We still live together because I can t really afford thousands of dollars on immigration lawyer trying to submit a waiver but at the same time I am under great amount of stress just being around her. I genuinely entered this marriage 4 years ago and so did she but now she just treats me like ####### despite me being nice to her.

I just want to get out of this marriage but I can also stick out till my I-751 result comes out. I just don t know if it s worth it to stay with her considering my case sounds weak with lack of evidence.

What options do I have? I d love to get out of this marriage and start my life but at the same time I would definitely not like to be deported when I didn t do anything wrong but being nice and genuine to my us citizen wife while trying to keep this marriage alive when she was the one who wrecked it.

Any advice is welcome!! Stay safe everyone
