US Immigration from South Africa

Hello fellow VJ members,

I applied for a K1 in April and COVID-19 made things worse for multiple people. I expect a long wait ahead for the final approval 2021 if lucky enough. However, I wonder can I apply for a tourist visa to visit my fianc e in US? Yes, I know about the bans traveling. Mainly would it interfere if I file for that while a K1 is processing.

I didn't see a group for this so I thought I would start one. Since we are included on the ban exclusion list atm, the only thing holding up the line for IR1/CR1 visas is on the South African side. It appears that Cape Town consulate (non-immigrant only) has reopened, and Durban's consulate (non-immigrant only) will be reopening in August. We have contacted Johannesburg's consulate and they are still closed for all consular services, however they told us they will be looking at the cases which are exceptions under the ban in the next few weeks. We also reached out to the doctor who provides the medical checks for the consulate in Johannesburg and they have a list of people they have promised to contact as soon as they receive word from the US Consulate about opening/resuming immigration interviews.

According to the understanding of the recent court ruling, the lockdown is basically legally over. However, as we know, the government could decide to come up with a new lockdown requirement at any time. If you guys hear any news about the level of lockdown for Gauteng, Johannesburg specifically, please post the info here. The other big hurdle will be finding ways out of SA with the severe travel restrictions in place. Quite a few people have bought tickets on different airlines just to have them cancelled, so if anyone knows anything about the status of OR Tambo, it would also be greatly appreciated. There have not been any notifications of repatriation flights for US Citizens for awhile, so we may have to wait until commercial flights become available once more.

My now husband entered the US on March 5th 2020, shortly after the country went to lock down due to the pandemic. We manage to apply for his SSN on May 14 and they sent us a letter stating that they will get back to us in 4 wks but we still didn't received it up to now. his Visa expiring date was on june 02, we struggle to get married in Pennsylvania on may 29 but the county we live in Maryland woundn't record it so we had to redo it on june 12. on the same june 12 we sent the AOS packet to USCIS and they received it on june 16. and yesterday they returned the entire packet. I am a bit confused on the wording of what they wrote as english is not my first language. I struggle with it Im just reaching out to see if you could help me out I don't want to sent the package and they will reject it again. so i will write word for word what they wrote on each letter.

for I 485

" ..... your I 485 fees, and any supporting documentations is being returned to you for the following reasons

the application/petition has not been fully completed. Based on the selection made under Part 2 Application type or Filing category, the form I 944 and/or form I 864/I-864EZ are required."

I submitted the form I-864 with supporting document ie tax returns, pay stubs and W2s, I can't get hold the IRS to send me my transcripts.

For I-765

" ....... the principal application could not be accepted for the reasons specified on the related Notice of Action ( form 797) therefore the processing of all riding applications cannot continue."

For I-131

Does anyone know if the consulate in Johannesburg is open and processing?

My fiance and i have had our application at the NVC in New Hampshire since April and it was at the USCIS in California since last November , I called and got the receipt number also

When it arrived at the NVC it had JHN letters now with a new case number but every day I have checked since April it says "At NVC " does anyone know what the hold up is? is it a USA hold up? or is the problem in Johannesburg?

Is there anything i can do to help expedite? My Fiance and her Daughter are waiting on their Police Clearances but those seem to be taking forever also

I am very upset, lost and confused. I don t want to air out my issue on this forum. My relationship sadly isn t working out as I wanted to. How do I go about withdrawing the application I know I have to write a letter but, what does it need to include. Also if it s at CSC which lockbox do I mail it to?
