Hello everyone,

I was wondering if anyone has any insight or can point me in the correct direction. Does anyone know if the Cape Town embassy are processing interviews for the K1 visa? I am a US citizen and my fiance South African are in the middle of the K1 process. We are awaiting our approval and I have been wondering with the states ban on travel from SA and select countries will the embassy still honor are application. I would love to hear from anyone who has either gone through a recent interview or anyone with any insight. Thank you in advance

I-864 help - Proof of Income

Hi Everyone,

I am the petitioner/ sponsor for my South African husband and we live in South Africa together. I am currently a PhD student here in SA (and work part time for myself) and don't have US 'employment income' to show. We live off my husband's salary, as well as my own US savings/ investments. My husband actually already works for an American tech company as a remote contractor, but I don't believe his income counts for anything.

I've been looking around on the USCIS and VJ websites to determine if the SUM of my savings/ investments (which exceed the poverty limit guidelines) will qualify towards being sufficient evidence of finances to sponsor my husband for his CR-1 spousal visa, or if I'll need to ask my parents in the US to be a joint sponsor. I do file and have yearly tax returns for income generated from these savings, but its rarely for more than $15k because of the lower cost of living here in SA, which is then less than the poverty guidelines for sponsorship. Is proof of the sum of my assets enough or just the income gains on tax returns?

I just want to be safe and file things correctly so as not to waste processing time by being requested later on to submit additional documents for a joint sponsor. Is it worth just submitting with joint sponsors anyway just to absolutely make sure I cover my bases?

AND, if my savings/ assets DO count and make an additional joint sponsor unnecessary, what types of additional forms or special documentation would be needed?

Evidence of income

If you completed Form I-864, I-864A, or I-864EZ and the income reported on this form or your tax transcript reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. This can include evidence of current employment or self-employment, recent pay statements, a letter from the employer on business letterhead showing dates of employment, wages paid, and type of work performed or other financial data.

  • For those who are unemployed or retired, submit a photocopy of ongoing income from other means, such as:
    • retirement benefits;
    • other household members' income; or
    • other significant assets.

Hi everyone,

I'll apply for US citizenship in 2 years time. How do I go about bringing my kids over once I am a citizen? I've seen there's a I130 and a IR2 visa..

It looks like the IR2 visa requires me to live with my children overseas for 2 years prior to applying??? That is crazy considering I have 3 kids, 5 years between youngest and oldest.

they legally can only choose to live with me once they turn 18. (In south africa)

If I can get them at age 18 to choose to live with me, how would I go about getting each one over?

Hello guys

I sent off my AOS package on the 16th of February to the Chicago Lockbox, and it was received there, but unfortunately I have not received receipt notices. I know that things have been delayed so trying to wait patiently.

My question is: for some reason I was under the impression that i had to tick the EAD renewal box instead of the initial application since I already had an EAD from OPT. I now realize that i should have ticked initial since it's considered under a new category. I sent a scan of my old EAD, and made it clear that this was an initial application for AOS, entered the right category, but I just ticked the wrong box (renewal).

Do you think the application will be rejected/sent back or will they process it as if it is an initial EAS for AOS?

Any help is appreciated, but I know it is kind of a niche case
