This isn t specific to this subforum but it relates to a family member though the question is for any similar situation: if a new immigrant gets their MRIV immigrant visa, can they be processed for official admission into the U.S. and get an I-551 stamp at U.S. reclearance airports such as Abu Dhabi, Dublin or the many Canadian airports? Or does it have to happen at an airport in the U.S. itself?

I recieved the following message from NVC regarding my wifes IR-1 Visa application. I have a few questions but some background:

-Location: Riyadh Saudi Arabia

-Income reported for last 3 years (102k, 98k, 95k,) with a Tax Return Transcript for most recent year submitted along with I-864

-I recieved this message a few days after recieving my Documentarly Qualified email.

-Proof of Domicile was requested and provided

"The income reported as stated on form I-864, I-864A is insufficient to overcome the public charge grounds of inadmissibility for visa issuance. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos and https://www.uscis.gov/i-864p. A consular officer will decide if you meet these requirements at the time of the interview. Note: You, as the sponsor, and any other sponsors household members and joint sponsors, must provide updated or additional evidence for the applicant to present at the time of their interview such as: * Other income * Assets * Proof of current employment Note: You submitted documentation to the National Visa Center through the Consular Electronic Application Center CEAC. You can continue to upload documents to CEAC up until the date of your visa interview"

1)Isnt my income suffient enough given the figures i stated?

2)For the part that says "Note you as the sponsor must provide updated or additional evidence to present at the time of interview"

-Other income: dont have any

-Assets: Own two cars thats about it

-Proof of current employment - have not provided any documentation of that up untill now.

Would appreciate some insight on how to proceed. Should i get a joint sponsor? any advice would be appreciated.

We haven t hired a lawyer but we consult with one every now and then. He told us just to add my family s house in the US as an asset (it s fully owned by the two immigrants) and that should be enough as it s a highly valued house. He said even if you have zero income as a sponsor that the house being an asset should be enough. But we got the case FE message, which looks standardized:

The income reported as stated on form I-864, I-864A is insufficient to overcome the public charge grounds of inadmissibility for visa issuance. You can continue to upload documents to CEAC up until the date of your visa interview.

Is this indicative that they could still require a joint sponsor or would the house as an asset be enough as per the lawyer s advice?

Can my spouse leave the US while her I-751 is processing?

My wife and I plan to visit her home country outside the US around Christmas on 12/25/23 and return by 1/15/24. Her green card expires on 1/24/24. The earliest I can submit the I-751 documents is 10/26/23.

The questions I have are as follows:

1) Will her new permanent resident card (without conditions) likely arrive by mail before Christmas so we can travel?

2) If not, can she travel on her current green card (with conditions) as long as we return before it expires on 1/24/24? Perhaps we can bring documents that we've submitted all of our documents for removal of conditions? Will she have issues returning to the US with her green card right around expiration?

Thanks,

Hassan
