Conditional Green Card has application date instead of approval date

Hello everyone,

I searched to see if anyone had the same problem, but I couldn't find any topic.

I was talking with a friend about green cards and when we needed to apply for removal of conditions and I realized that my green card has the dates for residency and expiration based on the dates I sent the package and my friend had the dates based on when the petition was approved. I tried to find what dates would be correct and it seems that mine is wrong.

Does anyone know if this happened before and what was done to solve the problem? I do not want to apply for ROC on a wrong date. I also used the green card for employment and driver's license and I do not want to be accused of any illegal activity, but I just learned know that my card may be wrong. I tried to contact USCIS but had no success.

Thanks for reading! I appreciate any help you can give.

K1 visa at French Embassy

Hi all,

Just found the site, wish we did sooner! I am a US citizen and my fiance lives in Portugal. We submitted the I-129f in August of 2019 and got the email that the NVC has forwarded our approved stuff to the French Embassy on March 31st.

Then the Covid happened and some of the anti immigrant executive orders.

Just checked: in early June status was changed to waiting for an interview.

Couple of questions:

1. Does anyone know if the French Embassy is doing K1 visa interviews?

2. We wait for something from the embassy before proceeding? I am not sure when she should fill out the DS160.

Thanks!!

I-944 not needed anymore?

Hi all,

My wife was on the USCIS website looking for information on the I-944 when she found this:

"Applicants and petitioners whose applications or petitions are postmarked on or after July 29, 2020, should not include the Form I-944 or provide information about the receipt of public benefits on Form I-485, Form I-129, Form I-129CW, Form I-539, or Form I-539A.

USCIS will issue guidance regarding the use of affected forms. In the interim, USCIS will not reject any Form I-485 on the basis of the inclusion or exclusion of Form I-944, nor Forms I-129 and I-539 based on whether Part 6, or Part 5, respectively, has been completed or left blank.

In any public charge inadmissibility determination, USCIS will consider the receipt of public benefits consistently with prior public charge guidance....."

And she tried to look for the I-944 form and it's suddenly nonexistent? What's going on?

This is found at this link:

https://www.uscis.gov/i-485

Does that mean we no longer have to do the I-944?

1. Part 1 #24

"What is your current immigration status (if it has changed since your arrival)?"
She arrived on Feburary 20 of this year. We got married in April. Her I-94/K-1 Visa expired in May. So she is overstaying right now. We have read countless posts here in VisaJourney with so many conflicting answers.
Do we list her as out of status because she is overstaying right now? Or do we list her status as unchanged because we married within 90 days?
We even tried checking her case status on the USCIS website, but it hasn't been updated since our I-129F got approved.
2. Part 1 #25
It asked for my wife's name exactly as it appears on her Form I-94. That shouldn't be a problem, but her first name is misspelled with two letters missing. Do we write down the mispelled name that is listed in the I-94 form or do we write her ACTUAL name? We are probably over-thinking this, lol.
3. Part 8 #17
"Have you EVER violated the terms or conditions of your nonimmigrant status? Yes or No"
As mentioned above, my wife and I got married within 90 days. But we haven't filed our AOS yet so that means she is overstaying. We read so many conflicting answers here. Do we check YES because she is overstaying and we haven't filed the AOS? Or do we check NO because we married within 90 days?
Many thanks!
