Hello,

I am the sponsor for my K2 follow to join step children (ages 10 and 16). We received the following RFE language (see below) for my AOS K2 follow to join packet(s):

Based on the language of the RFE, I think the problem is that I didn't list my wife as the principal immigrant because she is already here in the USA. I listed my stepchildren as the principal immigrant because my wife is already here. So, to correct this, my plan is to resubmit the latest version of the I-864 form and do the following:

1. List my wife (K-1 recipient) as the principal immigrant

2. Check No on Question 1 of Part 3 (I am sponsoring the principal immigrant named in Part 2)(No - Applicable only if you are sponsoring family members in Part 3 as the second joint sponsor or if you are sponsoring family members who are immigrating more than six months after the principal immigrant)

3. List her children (my stepchildren) as the two family members in Part 3 Family Member section

4. Check the box on Question 3 of Part 3 (I am sponsoring the following family members who are immigrating more than six months after the principal immigrant)

5. Enter 2 in the box on Question 29 on Part 3 (Enter the total number of immigrants you are sponsoring on this affidavit which includes the principal immigrant listed in Part 2, any immigrants listed in Part 3, Item 1-28, and (if applicable), any immigrants listed for these questions in Part 11. Additional information. Do not count the principal immigrant if you are only sponsoring family members entering more than 6 months after principal immigrant.)

6. I verified that household size is correct at 4.

a. Provide the number you entered in Part 3, Number 29 (2)

b. Yourself (1)

c. If you are currently married, enter "1" for your spouse (1)

d. The rest are 0

I can't think of any thing else. I would love to get feedback from the forum on whether I interpreted the RFE correctly.

Just filed a CR1, is it possible for my wife to visit me on a tourist visa?

Hello everyone,

I have recently gotten married and just started my CR1 Visa process. My wife is from the Philippines and was just curious if she'd be able to visit me on a tourist visa? Are the chances very slim to get approved even if she's able to prove ties to Philippines like job, mortgage, etc?

Any insight on this would be much appreciated. I'm planning on visiting her next year but if she can come here instead that'd be much better.

Wedding plans question during K1 visa interview

Hey guys. Me and my fiance had made wedding plans, but we only talked about it through chat and phone calls. We have no official documents yet, that means no wedding invitations yet, and we haven't made an agreement with venues, officiants, etc. We're planning to do that once I get to the US.

If the CO asked me if me and my fiance made wedding plans already, should I say yes, and if they asked for proof, is it acceptable to show just the screenshots of us talking about it? Or should I say no?

Hi Folks,

It's been awhile since I posted here & as such a lot of this stuff is a little foggy in my memory. My wife & I (she came here as a K1 fianc visa holder) need to bring her 4 year old son to the US as part of the follow to join option. Both her 4 year old & her 10 year old was included on the original K1 visa application, but only her youngest will be joining us. She received her K1 VISA on May 4th, 2023 so we are assuming that he will need to get his VISA issued to him prior to that date. What we are trying to determine now is the best way to get him here that will account for any bumps we may have along the way. He already has his passport. As far as I know & can recall from the original process, we still need to complete a DS-160 for him, complete his medical examination & finally the embassy interview. We know that we ideally need to get his medical exam done at least 2-3 months prior to his interview just in case he gets flagged for the 2 month sputum test.

Can I go ahead & complete the DS-160 now even if we have no plans to do anything until 2024? I'm not sure if that DS-160 is only valid for a period of time or not. Do we complete the DS-160, pay the MRV fee, then set up the interview & then schedule the medical exam? Am I forgetting anything? I know the medical exam is only valid for 6 months...so the earliest we should consider having him do the medical exam is in November or December for it to last through May. Does the medical exam need to be valid post entry into the US? I'm guessing we'll be starting his AOS shortly after he arrives in the US as well.

Any input or guidance would be greatly appreciated.

Hi there,

This is my step-son's (age 12) case. My wife is a permanent resident and her son is in the Philippines. We've been waiting for a long time for the interview to be scheduled.

On Nov. 16, 2021, his case was documentarily approved. All that is needed in the interview.

VISA CLASS: F22
YOUR CASE IS CURRENTLY AT: NVC
FOREIGN STATE OF CHARGEABILITY: PHILIPPINES
INTERVIEW LOCATION: MANILA
PRIORITY DATE: 30-SEP-2019

The Visa Bulletin For October 2023 (state.gov) shows for F2A in Philippines this: Feb, 8, 2019.

If my step-son's case priority date is Sept. 30, 2019, how do I interpret what the bulletin says, and approximately how much longer could we be waiting for an interview to be scheduled?
