Is it possible to submit AOS without approval of I-30?

Hi!

We already submitted our I30 and I30a and we only have the first NOA: receipt.

so, Is it possible to submit my AOS packet even though our I-30 isn t approved yet? Do you guys think they ll accept it since I am already in the US.

Ps. We did not do the so called concurrent filing since we thought the I30 should go first. It was just now that we learned we can file them together since I am already here in the US

First Time Filing Taxes with K1

Like many right now, I'm filing for the first time in a K1 situation. I've read through a lot of threads trying to understand what's required of me to stay on the right side of the law. I'm seeking a little reassurance that I've interpreted what I've read correctly. Thanks in advance to those that review/provide guidance. VJ in general has been a lifesaver in this long, rewarding, and sometimes trying process.

My Situation:

  • My fiance arrived to the US in August 2019 and we married later that month, so she does not pass the substantial presence test. Currently going through AOS.
  • She made Zero income in 2019 (either in the US or her native country).
  • She has her SSN since September 2019

Proposed Tax Filing:

  • Based on what I've read in this forum, MFJ (vs MFS) is likely the way to go to minimize income eligible for taxes by $24K.
  • There's no need to complete IRS Form 2555 as there was no foreign income earned, or alternatively, state on that form $0 income earned.
  • Include joint declaration paper letter from my wife and I that we were married at the end of tax year 2019 to be treated as US residents for the entire tax year (per IRC6013 (g))
  • Must file via Mail as e-filing in my situation isn't possible (even though personally preferred)

Do you guys have properties abroad? If so, how did you add them to your deductions as to mortgage interests? since 1098 are no available?

Hello, just a quick question. We are getting ready to send out our AOS packet this week, I originally prepared everything in the middle of the december, but due to some emergencies, i didnt have the money to send it out then. If i keep the dates of December of when i orginally prepared it and send it now do you think this will be a problem? Im just trying to avoid having to refill out everything with new more up to date dates. I may just end up doing it regardless for peace of mind lol.

Update SSN after Marriage and AOS - K1

Hello all,

I got an SSN before I got married, and now I'm thinking of going to the Social Security office to have my info updated to my married name. However, I found this on the Social Security website:

" Corrected Card for a Noncitizen Adult
If you change your name, become a U.S. citizen, or your immigration status or work authorization has changed, you need to tell Social Security so we can update our records and when necessary, issue a new card. "

The thing is, my AOS packet is still pending. Once my applications come through, am I supposed to "declare" to Social Security that AOS and EAD have been approved? Does that mean I shouldn't have my name updated until then? Because I might be wasting a whole trip/process if I'd have to come back after approval anyways.

Need advice on the matter.
