Philippines 13a visa (residency based on marriage) - Are there any advantages of applying while still in the US, or is it better to wait until after arrival in Philippines and apply there?

Hey guys,

So we re currently working on gathering all the documents and evidences for my I-751 but I have a concern I need clarification on.

I recieved my conditional green card in March 2021. We moved in in our apartment on February 2021 and we have lived in my spouse s parent s home before moving in to our own place. I have a lot of evidence to provide(lease, banks statements, bills, etc) using our current address but for other evidences, like our car insurance, we completely forgot to change the address right away and it wasnt changed till late last year so some statements have our old address.

I guess my questions would be:

1. Is it okay to keep those evidences and submit it anyway? Maybe add a copy of our old licenses with the old address and include an explanation that we didn t get to update the address right away?

2. Should I add that said previous address on Question 22 of the I-751 Have you resided at any other address since you became a permanent resident ? I m really doubting on this one since we re already in our new place since I got my green card.

3. Or should I just ignore those evidences with old address and settle with all the other evidences?

It s really hard doing all these without a lawyer/professional to work with so I would really appreciate all your suggestions and thoughts on these!

So today I received a text and an email from USCIS saying the following:

*** DO NOT RESPOND TO THIS E-MAIL ***

There has been a recent processing action taken on your case.

Application Type: I129F, PETITION FOR ALIEN FIANC (E)

Your Case Status: Decision

On January 13, 2023, we began reviewing your Form I129F, PETITION FOR ALIEN FIANC (E), We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by January 27, 2023, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.
  • Log-in to your myUSCIS account to view your case history and understand what you can expect to happen next on your case.
  • Current processing times can be found on the USCIS website at under Check Processing Times.

Sincerely,

The U.S. Citizenship and Immigration Services (USCIS)

However, it doesn't provide or state the status of approval/denial. Can someone explain to me what this may mean. I called USCIS three times today and the last lady told me it's not abnormal to receive a notice like this by email or text that doesn't show whether the case has been approved or denied but she said normally if it's declined that your status online would show declined but to wait for the letter to arrive by mail within two weeks and follow the instructions in the letter. So she gave me a little peace of mind bcs at first I was kind of mad or upset bcs I've never received a notice of action 2 letter from uscis that doesn't show the status right away. Pls assist me if you guys have had this happen. The last time I filed for my ex-wife in 2010 and my case was approved they sent me a text and email as well as the noa2 in the mail stating the approval and what steps are next.

Planning on leaving June 2023 , u are asking NVC to delay the interview too long

the medical for a june visa expiration would have to be done in January 2023 as the visa expires 6 months from the medical exam

you can only delay NVC AOS and ds 260 documents a year

NVC recd your case 2/25/2021 so the year will be up in February 2022

I would file all and cancel (if needed)

BUT this is on USCIS site

https://www.ustraveldocs.com/vn/vn-iv-reschedulevisa.asp

Can you delay visa interview?
You may only schedule a new visa interview appointment if you missed your previously scheduled immigrant visa interview appointment. If you schedule a visa interview appointment before the date of your initial immigrant visa interview appointment or meet any of the conditions below, you will not be interviewed.
Keep in mind the queue is long for Philippines and u may be waiting (in your needed timeframe) just to get the interview

Where does that one year rule come from, and what constitutes the termination of the year? We filed at NVC in March 2022. We're not in a hurry and would prefer an interview in April 2023, so that we can go to the US in late September 2023, after our second anniversary. We just got an unrequested expedite and our case went to Manila January 9. Does having an interview scheduled stop the one year clock you mentioned, or must the interview actually be conducted? Thanks.

Hello. I did a search on VJ for this and couldn't find anything on point so....We.Paid the IV fee on March 22, 2022. Interview is not yet scheduled and case just left the NVC for Manila Embassy on January 9. We're not in a hurry, but if the fee does really expire, can I just pay it again or what do we do? Hoping someone's got an answer for this. Thanks
