Hello VisaJourney folks,

I posted seeking help last year to get guidance on how to obtain an ADIT stamp for my mom who lost her green card. She lost her green card during a health episode that put her in the care of a psychiatrist to this day. She was able to obtain the ADIT stamp successfully.

Unfortunately, her health has not shown significant improvements to date and she has continued to need support throughout the day most specifically during medication administration. We are also scheduling doctor appointments with a neurologist and other specialists for memory care as she has shown early onset dementia symptoms.

My sister and I both have children and full time jobs, and it s been a challenge to manage everything and stay afloat. We will be doing everything to support my mom, and one of the things we thought about is to try and bring my brother to the US to be my mom s primary caregiver.

My brother is turning 37 years old in Sept, not married, and has no kids. He is willing to pause his life to come and support my mother and us.

I am in the process of obtaining guidance from immigration firms who offers free consultations for now as I don t know what route I ll need to take to make this happen. I also want to make this as cheap as possible.

I m hoping that someone on here have gone through the same process and has been successful, and I would greatly appreciate if you can shed a light on what steps and routes you took. I also welcome everyone who knows and have related experiences to share them. Thank you all in advance!

Some items for consideration:

1. My mom is a permanent resident waiting for the replacement card. She currently has an ADIT stamp.

2. One attorney suggested that my mom as a permanent resident can sponsor my brother and the current wait times is 5-7 years.

3. We are also thinking of applying for my mom s naturalization if this will help any. She met all the requirements and is eligible for a few years now.

4. My sister and I are US citizens. Sponsoring siblings current wait time is 15-20 years.

5. We are hoping to get my brother here as soon as possible, and we aren t sure what visa would be most appropriate, and if there is a specific visa category for this purpose.

Does US EMBASSY in Manila automatically extend the petition validity if the visa application is under administrative processing?

The consul asked me to re-submit an NBI clearance. I've submitted it yesterday (July 29) but the I-129F petition is about to expire on August 4. Do we need to email/ call the US Embassy here in Manila to extend the validity of the petition? Please shed some light as we've tried contacting USCIS but to no avail.

DS-160 verses DS-260?

Maybe to late for this, just got an interview, mid August. I completed the DS-160 form, all proper, got the completion letter. I see reference to DS-260 at times, did I do the wrong form? Standard K-1 visa?
Right now it s off to schedule the medical, then collect all the required documents. We/she has them, just need to go through the checklist.

My main question now is the ds-160 verses the 260. If I did the wrong one, do I do the 260 now? Thanks.

I'm currently awaiting my EB3 unskilled petition with a priority date of December 27, 2021 via consular processing in Philippines. I applied for this job in early 2020 and I work as a nurse in Dubai without an NCLEX certification. I've been offered a new opportunity in Texas where the agency is willing to sponsor me for my NCLEX test and hire me. They mentioned that they will file a new I-140 for me, as they claim I can't use my previously approved I-140 due to it being in a different category. I'm unsure whether I should wait for my previous priority date to become current and take the NCLEX once I'm in the US, or if I can apply for the new opportunity without affecting my previous application. Any advice on what I should do in this situation?

I am hoping someone out there can answer my question. I will state it succinctly and then provide some details after.

DO LAWYERS AND CONSULTANTS USE THE SAME PROCESS AS INDIVIDUALS TO SECURE AN APPOINTMENT FOR AN INTERVIEW?

Let me explain...

  • My Filipina fiance and I are trying to obtain a K1 visa for her.
  • Due to cost, we decided to go the route of doing it all ourselves and not use a lawyer or consulting service.
  • We are at the point where we have been prompted to schedule an interview for an appointment.
  • For many days now, there are no appointments available.
  • The process for getting an interview appointment apparently is to refresh your browser 12 times a day, every 2 hours until it shows an appointment available.
  • I have read a lot of forums and this seems to be the way you have to do it.

So, that leads to my question... Are the lawyers and consultants seriously sitting at their computers going through this asinine process to get their clients an appointment? Do they have a back door they use to get the appointment slots?

To say I am frustrated is an understatement. You can walk across the southern border and get a free cell phone, accommodations, paychecks, etc., but it takes buku months if you want to do it legally. Government bureaucracy is maddening.
