I-129F [Manila] approved 2 years ago, still doable?

Hello there, it seems my old post went missing.

I filled a I-129F for my fiance back in 11/2019, It got approved on 03/2020, then on 04/2020 I got the letter from the NVC with the MNL Case number, but then with covid and everything that went around, i lost track of the process, as well my fiance and I were not in best terms because we couldn't see each other and didnt knew how long the lockdown was going to last.
On 04/2022 I got an email from the Manila Embassy stating that my fiance was eligible to schedule an appointment, but we were not sure is we wanted to continue the process, fast forward to today, we have seen each other 2 times and planning to meet again around summer 2023.

My question is, can we continue this process as it is right now, doing the checklist and scheduling the interview at the Manila embassy, preferable around the time we will be together in Manila, or do we need to start a whole new process again.

I lost most of the papers i had on a flood and all i have right now, is a copy of the I-129F packet i sent back in 2019.

I have attached the only emails i got from this case, as they somehow were not linked to my USCIS profile, and had to link them manually.

Thanks for any insight that can be given.

Form I129F Section 3 Question 4.a

I filed form I129F, but I noticed now that Section 3 Question 4.a was not selected correctly. I chose "No" but I remember a dismissed case from 1999. I was 17 at the time, but I did get finger printed during processing. The case was a misdemeanor for telephone harassment that was eventually dismissed. I had completely forgot about it since its been like 23 years.

I called the local circuit court office, but I have a problem. The case deposition or case file has the wrong date of birth I was told over the phone. I won't be able to fix it when I go to pick up the certified case deposition. I was told that I would have to file a motion, and have a court hearing if I want the case file to show my correct date of birth.

Can I just send a letter to the USCIS field office in California with a new signed I129F form, an explanation, and the case deposition with the incorrect date of birth? I would likely need to hire a lawyer if they need the case deposition to show my correct date of birth. They could order a biometrics appointment if they need to confirm its the correct case since my finger prints would bring it up.

Should we anticipate an RFE for a joint sponsor? I'm (petitioner) self employed

I'm sponsoring my husband and am self-employed (and have been for 17 years). We worked with a lawyer to prepare our package (130, 485, etc, etc) and they submitted 3 yrs of full accountant prepared tax returns (with all supporting 1099's, etc) plus 12 months of of statements for all of my bank and investment accounts for assets (talk about a lot of paper). The lawyer said we don't need a joint sponsor but I'm not so sure. They did a poor job so I don't trust them.

I made over the required amount for a household of two in 2019 and 2021 but not in 2020 b/c well, you were all there, you saw what happened. 2022 taxes are not ready yet but I will again make more than enough. My total assets fall just under the requirement at 65k, but we also included his assets which puts us over the baseline. I've read old threads about self employment and the info is conflicting. I am concerned that the lawyer did not ask me to write a "letter of employment" for myself or provide any business license or anything else.

Should we line up a joint sponsor or are we probably ok?

I-751 question

Hi all. I am sorry if I am contributing to an abundance of redundancy on these forums, but I have forgotten almost everything about these processes since I last attended to it

Me and my wife filed our I-751 on 07/01/2021 and received a notice on 11/08/2021 informing us that her status was extended 24 months from her I-551 expiration date. That s 09/26/23 this year. Since we have about 7 months left I would like to refresh myself a bit on what I might need to be looking out for.

At what point should I seek to press for a response from the USCIS? Do they require I contact them in a particular time frame if no update has been provided? And lastly what would become of my wife s legal status if that date comes to pass without an update?

I appreciate any advice.

Good day VJ!

I don't know if i post this at the right topic but i hope our experience help someone else who process the same way.

K2 FTJ over 1 year APRROVED!

Medical @SLEC:

2 exhausting days but worth it. No issues.

VISA Interview:

3 children age 9,7 and 6

- during interview only 9 y.o allowed to enter

- their biometrics is my left handprints.

- requirements asked ds160, pictures, birth certificate, kid's passport, medical, copy of expired K1 (cancelled passport).

- questions asked to me: are you the mother of (kid's name)? their date of birth, age and have you been to the US? Your maiden and married name pls? How old are you? when did you got married? Your POE? When did you adjust your AOS in America? name of the petitioner? How old is he? How do you like America? You like the cold? what state?

- questions to my son: How do you pronounce your name? "klod"? , have you seen snow before?, are you excited to come to America? *giggle*

consol: Alright, i see no reason not to approve your visa, Congratulations! and enjoy your travel!

*visa arrived in 10 days* (outside Manila)

K2 arrived in US: Feb 03, 2023

POE: Chicago, Illinois (O'Hare)

My question:

1. My husband and I want to process their adjustment as soon as possible get their social security first but i couldn't find for K2 requirements only. I will be pleased if anyone can help. They are going to school on the 20th or 23rd this month.

Advance Parole while adjusting AOS as K1(married) leaving the country experience:

Leaving the country (US): NO ISSUES

Leaving the Philippines with K2 kids and USC husband:

-if you renewed your passport to your married name always bring the old passport (cancelled) especially your expired visa is there cos they always asked for it.

- first plane, security took copy of my expired visa and AP (they don't know what AP is and how is it related to my expired visa and AOS) took them an hour to understand what it is for after me explaining again and again.

- layover -> before boarding security read and understand my AP and let me board in 15mins

- at POE kids visa are all good and the officer saw the envelop (AP) he immediately read and told us to wait on the side to get it stamp.

It's wild and exhausting experience travelling with 3 young kids but worth it and thank you VJ because lot of information from this site helped us a lot!
