Wife and Step Son - NRA Dependents

Newly married last year and this is the first year filing with her.

I have heard many people filing married joint with their spouse and simply putting Non-Resident Alien in the SSN box of the form. I was trying to go through getting an ITIN for my wife but there is an issue with the place I am trying file with and getting that done so I was thinking of opting for the NRA option. What are your thoughts?

Secondly, i have been supporting my wife and step son (16) for more than half the year. The question is could I add him as a dependent and again add NRA in the SSN field? It is too late to get him an ITIN even if I could at this point. They are both my dependents and I can show through monies sent that I am supporting them. So can I do this NRA option for both of them?

Thanks for any help.

Hello,

So I come across a post on Facebook about a tourist visa holder who is adjusting after marring an LPR. Is that possible? I thought you can only adjust through marriage to a USC?

I tried looking for reference on the USCIs website but I can't find a solid reference.

What do you guys think?

Limited Number of Interview Rescheduling?

Hey Folks,

I just wanted to see if anyone knows if this is true or not. When we initially scheduled our K1 interview appointment, we took the first available appointment which was June 8th at the time. Since then we have noticed that on occasion there will be earlier appointments made available on the scheduling website (likely due to canceled or rescheduled interviews). We have decided to take advantage of these earlier appointments & have moved up our appointment to June 1st. We were hoping to continue to monitor the site for any earlier appointments prior to our scheduled appointment, however when I logged in to the site today I noticed the following note:

"If you cancel this appointment, then you will have exceeded the limit of appointments canceled, and will not be able to schedule another appointment until another MRV fee has been paid."

Does this mean that if we attempt to reschedule our appointment to any earlier appointments (should one open up) that we would have to pay an additional $265 MRV fee? I sent a message directly to the embassy for clarification as well. I think the spirit of the rule...if this is one...was to prevent people from continuously postponing their interview appointment due to scheduling their interview before they were ready. It wouldn't make sense to penalize those of us who are waiting in line & want to take advantage of an earlier appointment when it becomes available.

Thoughts?

AOS/Affidavit of Support Question

I could really use some help please. My wife is here and I am filling out the AOS paperwork for her. Her son/k2 will be coming after 6 months. Do I include him on the paperwork for the 864 (Affidavit of Support) or do I wait until he is physically here in the USA? I'm confused on this. where it asks on Part 3, information about the immigrants you are sponsoring. I would just check I am sponsoring the principal immigrant named in Part 2, which would be just her right or would also check the box stating I am sponsoring the following family members who are immigrating more than six months after the principal immigrant? That's the part that confuses me and then listing her son as Family Member 1 with his info? If anyone could help. I'd greatly appreciate it!
