Hello all,

Recently had my fiancee K1 visa approved and she will be coming here to the USA next month. I just had some questions on the process and filing of all related paperwork. What forms should I file and in what order so that she is able to legal stay and would be able to work as soon as she is legally allowed to? I am aware of the forms I-130 and I-485 but I wanted to make sure I am correctly filling them within the correct time frames and in the proper order. Also how are the fees for filing? Appreciate all advice and help from everyone. Thank you,

Hello,

I m seeking advice regarding my mom s immigration situation. Here s a brief overview:

  • Current Status: My mom s IR5 visa is pending approval, and she needs to enter the US by the end of October.

  • Situation: I m the spouse of an active duty military member, and I am the petitioner. We are currently stationed overseas.

Given our circumstances, I m wondering if it is possible for my mom to enter the US and then travel outside the US within a day or a few days to join us at our current overseas location. If not feasible, the other option is to have her stay with a distant relative.

***to make things more complicated and just for additional information that might be relevant to the situation, we are starting the process of adding my mom as a secondary dependent of my spouse. This is to have her added to the orders and be with us in the US or overseas. But for the meantime, I wanted to get any insights regarding the above situation while the dependency application is pending***

Any insights or advice on this matter would be greatly appreciated.

I-129F Mistakes

Hello everyone!

We just started our k1, we sent our packet already and after 7days my fiancee received a I-797C the reason for it
is that we filled out a old version of I-129F. Third party, working with us mistakenly give as a old form,
but then we go through all of it over again and sent it after making corrections and proof reading everything
,but my concern is that on Page 8 no. 54 (where you have to describe
the circumstances of meeting in person) our third party mistakenly put 2024 intead of 2023. We overlook
that mistake even thouroughly proof reading everything. Me and my fiancee
is so going through stress about it because we already sent the packet to the p.o Box and theres no way
we could halt the packet. Thanks guys your thoughts and experience about this one would help this most important
time of our lives.

Hi Everyone!!!

Once again I am here asking for help and advise through this process. So I came to the US via K1 visa and we are now married for almost 1 month. I have been complacent about the next step after the marriage so I haven't done any research about that beforehand which I am now regretting.

Lots of question on the way but here the one's I can think of now. Hope somebody can help.

1. I have just read that there was an option of getting a SSN before marriage right after arrival. But since we are now married and already on the way to process the AOS, is there still a way to get SSN sooner? We are using RapidVisa as our filler but they haven't mentioned that it is an option to get SSN earlier.

2. Form I-693 - Medical Exam --- Again we received an email from RapidVisa informing us that I (beneficiary / AOS applicant) has to undergo another medical exam. But I have read on the USCIS FAQ that i don't need it? or maybe I have misunderstood what is says. (Please see below screenshot). But I have called rapidvisa and they say we may get a RFE if we dont submit another medical exam. I did not receive any copies of my medical report from the K1 as the hospital directly mailed it to the embassy. All I have is a vaccine record which we have already submitted as requested.

3. My husband is an active duty military and can be deployed at any time. Is there a way to expedite the AOS because of this. If yes, what are the process and additional requirement we can submit.

4. As mentioned above, (question 3), if ever my husband gets deployed, if it is possible we will try for me to get a government passport, agin we dont know if that is possible since I am only going thru AOS but if it is and we got a govt passport. Can I leave the country or do I have to stay here for the duration of the process until green card is released.

I am so sorry if any of this questions are silly but my dumb ### did not do enough research about this ahead. Hope anyone can help with any of this question. I would appreciate it so much.

Husband and Sponsor of Immigrant (via K1) wants a divorce after two months. Does he pay wife's legal expenses?

A friend of my wife has informed us that after 2 months her husband is filing for divorce. Due to the Affidavit of Support, which is part of the K1, isn't the husband responsible for all her legal fees?

I'm asking for the friend. My advice was that 'yes' she should hire an attorney, and she shouldn't be worried about being strapped with what would be financially crippling bills if later, she moves back to her home country where salaries are so much lower. My concern was that she might not hire an attorney, due to financial concerns, and then get crushed in the divorce proceedings.
