US Immigration from Norway

Hi,

I currently am in the process of getting a K1 visa with my fiance who lives in the USA. I live in Norway and I have two kids that are half american (their father is american, but he lives in norway, we are divorced). I am in the process of getting them american passports (we never actually registered them with the embassy, so I have to do that too). They are listed on the first part of our application for the K1, but since they are american I guess they can just move there, right? It feels like a dumb question, but how does someone with citizenship move to the USA when they have never lived there previously? Is there something we have to do before they move?

We have been going back and forth, and decided to finally apply to the K1 visa. Very exciting!

I will be visiting both this summer and in the fall, the latter which could maybe get me some extra questions but i have a house and a job and kids at home and it is just a short stay so I am not too worried. I will be sure to bring lots of documentation that we are just spending time together and I am not moving early. However, since we still do not know how long this will take, should I apply for a new ESTA before we start the process and send the first part of the K1? I am guessing you are not supposed to apply for one after applying, and I do need an ESTA to visit from norway- My current one expires next year in July, so we might get lucky or we might not. I mean I probably would not be visiting super close to moving anyway, but if something goes wrong and our application takes more than a year that will obviously be really sad.

Another question.. I am about to leave on a trip tomorrow, and we will be sending the application from the states so we get the wet signatures etc etc, but is it possible for me to apply while I am in the country? I mean my ESTA is still valid but I have already renewed it once because my kids and I visited last year and then i got us new ones so we would be on the same timeline. I googled it and it said that you can technically apply while still visiting if your ESTA is expiring before you leave, but I wanted to see if anyone had any experience with this. Thanks!

I am a Norwegian cititzen with a Norwegian passport. Since I met and got engaged with my fiance I have visited the US 6 times. But they never stamp my passport? We obviously have plane ticket pdfs with dates, but will the fact that I do not have any stamps in my passport be an issue?

I do not really understand why I never get a stamp.. lol.

We are submitting our I129f and I have sent my divorce papers to be translated. However, we use a digital system in norway where we basically sign with bank identification on papers (a digital signature, just as valdi), and thus my divorce decree does not have a physical signature. It says that the paperwork has been electronically approved, but that I can contact them for a signed version. Should I get a signed version to avoid a RFE? I am leaning towards yes..

My partner and I got married in the US whilst I was here visiting on a B2 visa. We already submitted the I-130 and I-485. On the I-864 my partner's salary is a little low, but we have assets to cover it. We sent in evidence of assets (confirmation from the banks) from both join accounts, his accounts and my savings account. We didn't read the small print that they would want 12 months average assets, so we now have to submit the bank transcripts after receiving request of evidence. My assets alone are actually sufficient, and the easiest to get all the bank transcripts from. But that money is in my bank in Norway. My partner's assets alone is also sufficient on it's own, but consists of a mix of bonds and different accounts - more complicated to gather together and to calculate the 12 months average. Our joint account is less than a year old (just since February). So I wonder if anyone has any experience if it's sufficient to give evidence of only beneficiary's assets. They are in an open account, I could transfer it very quickly to the US if necessary (but I prefer keeping them in Norway because of much better interest rates). I have a statement from the bank that the account is open. And if I only send bank statements from my own account should we sent a new I-864 updating the assets calculation and removing joint and his assets since we are not sending in all the evidence to prove it? Or should we really gather all the statements from all the accounts and send those in? Thank so much for any insight.
